Commissioner Getty asked about parking on Pico Avenue. Mr. Warnick said the area was changed because people were parking in the bike lanes from First Street to Cork Harbour. Commissioner Getty indicated it might be well when the use permit is heard for the school district to consider paving so that people can use the street rather than going up to Angela and make that an entrance. Chairman Jamieson said it is too bad that various areas can't get together with their schools. San Ramon needs schools and Pleasanton is closing them up for lack of enrollment. Cork Harbour Development Mr. Harris stated it was brought to his attention by Mr. Abbrott of the Pleasanton Heights area that the house on Lot 78 of Cork Harbour wasn't to be any taller than one story. He stated that as a condition of the siting and design review approval (March 1981) Mr. Abbrott addressed the Planning Commission and mentioned the site plan of the house on Lot 78 being 9-1/2 to 10 feet higher than his rear yard. At that same meeting a view easement was considered. Mr. Harris stated that Mr. Abbrott in 1981 asked that no structure be higher than elevation 448 feet. Commissioner Doherty motioned that no structure should be higher than single-story on the lot. He said the motion was then amended to reflect 448 feet and a single-story structure. Mr. Harris explained that the minutes clearly say 448 feet and a single-story structure while the resolution of approval only mentions 448 feet. Mr. Harris indicated that the house on Lot 78 is completely framed with gables going in both directions. Mr. Harris stated that Chairman Jamieson asked that this matter be discussed by the Planning Commission this evening. Mr. Harris further stated that all lots with view easements were surveyed recently by the City and one house ridge and two chimneys were found to be a few inches too high. Commissioner Doherty asked if Lot 78 interferes ith the view. Mr. Harris stated that since they lowered the chimney it doesn't encroach into the view easement. Assistant City Attorney stated he would have to check on the legal aspects of the discrepancy between the minutes and the resolution approving the project. Commissioner Wilson asked if there have been any complaints Mr. Harris stated there have been several complaints but it has been determined that one view easement is being encroached into, but Cork Harbour will have to lower the roof line. -12- _ _.
