MINUTES PLANNING COMMISSION September 14, 1983 Page 13 Chairman Jamieson addressed Mr. Abbrott, 4537 Mirador Drive. Mr. Abbrott stated that when looking out you see two-story buildings which are under the 448' elevation but houses to the west drop below eyesite. He felt that if the structure was a single-story unit, it would probably be five feet lower. Commissioner Doherty pointed out that from time to time mistakes are made. Commissioner Getty felt it was not necessary to change the record. Commissioner Wilson stated that Morrison made a mistake once and built a two-story where a single-story should be. Mr. Harris stated he has asked the developer if there was any way to modify the structure, but the design of the house would make it very difficult for them to lower the roof line. Commissoner Wilson stated that the City Council required the developer to have a minimum size house of 2,000 sq. ft. and it is pretty dififcult to build a one story 2,000 sq. ft. house on a small lot. Chairman Jamieson says the Abbrotts have lived in the area 19 years and his view easement hasn't ben fulfilled. He realized this is a tough situation but would like to sit down with the developer and see what could be worked out and felt it wouldn't hurt anything to explore the issue. He stated the Commission has an obligation to the people in the area. Commissioner Wilson indicated he felt the City Attorney should check out the legal position of the resolution and minutes concerning the 448' height and single-story structure. Chairman Jamieson suggested that a meeting be held between staff, the developer Mr. Abbrott, himself to try and work out a solution. Mr. Abbrott said he would be happy to attend such a meeting. Mr. .Harris indicated that the staff would try to have Mr. Beeler and his superiors present during this meeting and would try to set it up next week. Other Communications Commissioner Doherty said perhaps he wouldn't be present at the meeting of 9/28/83 but didn't know yet. Commissioner Wilson asked if anyone has approached the City Council about changing the ordinance regarding the attendance of the Commissioners. Mr. Harris responded that Pete MacDonald, City Attorney, was going to look into that. Commissioner Doherty said it is a shame there is now an alternate Planning Commissioner and the regular Planning Commissioners are penalized when they use him. Commissioner Getty stated she had listened to the tape concerning Cork Harbour and it was interesting that solar and other items were discussed which have never come to pass. -13- _ _ _. _ _ r. _ __ .
