He is opposed, however, to paying for fencing and <br />wants to the developers to do it. 450 feet of fencing at $4/ft. <br />is an expensive item. The solution proposed is okay as long as <br />the City does their job and inspects the fences once or twice a <br />year. He was concerned with second and third homeowners. <br />Chairman Doherty asked if there is anyone present who doesn't <br />agree with the plan. <br />The public hearing was closed. <br />Commissioner Lindsey asked if the City as any leverage in <br />accomplishing agreement with the homeowners. Mr. Swift indicated <br />that staff is recommending that the entire matter die if all of <br />the property owners do not sign an agreement. Staff believes <br />that to sign an agreement would benefit most of the people. If <br />the PUD modification doesn't take place, then the original PUD <br />will have to be enforced. <br />Commissioner Wilson asked about condition No. 5. Mr. Harris <br />explained that there would still be open space remaining as far <br />as he was concerned, but this is subject to interpretation. <br />Chairman Doherty would like two more conditions added: one <br />requiring that Cork Harbour pay for the flood storm drainage and <br />fencing and bear the cost of fees to prepare all of the necessary <br />documents. Mr. Harris suggested that wording 'all costs to <br />effect this plan' be added. <br />Mr. Harris addressed the Oak tree on lot 73 and the fact that <br />water is collecting around it. He would like to see this taken <br />care of. He indicated that the next step would be for Cork <br />Harbour to get the necessary agreements and bring them back so <br />that a final recommendation could be made on this. Mr. Swift <br />indicated another way may be to obtain signatures so that the <br />storm drain work and improvements could be accomplished quickly. <br />Commissioner Lindsey stated he would like to add to Condition No. <br />14 that prior to taking this matter to City Council that all of <br />the documents be signed. Chairman Doherty felt this would cause <br />a delay in the action. <br />Commissioner Lindsey made a motion seconded by Commissioner <br />Wilson to recommended approval of the plan dated 10/12/84 <br />requiring Cork Harbour to pay all costs involved with its <br />implementation; that on Lot 73 the Oak tree be taken care of and <br />that approval is subject to all of the conditions imposed by <br />staff.
