Minutes <br />Planning Commissi . <br />10/24/84 <br />Mr. Swift indicated that the fence would not be in the middle of <br />the easements; in some cases the property lines are but the <br />fences are not. He reviewed the location of storm drains, <br />swales, etc. A large surface flow is not expected in he back <br />yards. The need for having catch basins on top of existing storm <br />drain lines is greatly reduced. <br />Chairman Doherty then asked Mr. Warnick of Mr. Okamura could come <br />up to the front and review item by item the field survey of the <br />open area. Mr. Okamura then did this reviewing each of their <br />recommended conditions of mitigation. <br />Commissioner Wilson felt there were a lot of easements. Mr. <br />Swift indicated that this is why you need the signature of all of <br />the property owners. Commissioner Wilson asked who would do the <br />basic paperwork necessary to accommodate this plan if it is <br />approved. Mr. Swift indicated that Cork Harbour has stated they <br />will do it. <br />Commissioner Getty asked that if by some miracle signatures are <br />obtained what kind of action could be taken to ensure that second <br />and third homebuyers of the property would maintain this. Mr. <br />Swift indicated that title reports show all easements and this is <br />the only thing which can be used effectively to guarantee that <br />future homebuyers will be made aware of the situation. <br />The public hearing was opened. <br />Jeff Lawrence, Cork Harbour, reviewed the letter which they sent <br />to the Commission. The modification currently under <br />consideration is not at their request. Their proposal was to <br />reduce the open space. He offered previously to put together a. <br />plan which would cover the City's concerns and hopefully address <br />the needs and desires of the property owners. He indicated that <br />he does not represent each of the individual homeowners. He <br />believes that generally everyone except Lot 53 was contacted <br />about the proposed changes. They had not discussed fencing <br />coming down. It is not an uncommon situation to have double <br />fencing. He felt a lot of work would need to be done to <br />implement the plan (10/12/84). They need time to have the <br />documents signed. He indicated that he didn't fully understand <br />the scope of the drainage issue. He felt that this plan benefits <br />each of the homeowners in a major way. <br />Commissioner Lindsey asked about the fencing furnished by the <br />developer. Mr. Lawrence reviewed the fencing situation <br />indicating that in some cases it was a negotiated item in the <br />second phase of development. <br />Chairman Doherty addressed the original 14 lots and the original <br />title policies and whether or not the existing easements are <br />recorded on them. Mr. Lawrence said they are except for the <br />final 5 ft. easement. <br />Paul Miller, Lot 62, 4766 Peaceful Lane, indicated that he has a <br />swimming pool near completion.
