Tom Gallagher, 789 Kottinger, felt that Mr. Herlihy's comments <br />were correct, but he felt the wall was very attractive and an <br />enhancement to the area. He did not feel it is a hazard. He <br />felt that it did not create a traffic problem and that traffic on <br />Abbie Street is going to decrease with the extension of Bernal <br />Avenue. He understands the City's point of view with regard to <br />the possible liability but did not feel that a hazard would <br />exist. <br />James Raar, Fairlands Drive, asked if sufficient property could <br />be deeded to Mr. Howe as this would reduce the City's liability <br />problem. <br />The public hearing was closed. <br />A motion was made by Commissioner Getty, seconded by Commissioner <br />Innes that the appeal of the Planning Commission concerning <br />PUD-79-11-5M be denied. <br />ROLL CALL VOTE <br />AYES• Commissioners Getty, Innes, Lindsey and <br />Chairman Doherty <br />NOES• Commissioner Wilson <br />ABSENT: None <br />ABSTAIN: None <br />Resolution No. 2544 was entered and adopted denying the appeal of <br />the Planning Commission relative to case PUD-79-11-5M. <br />Commissioner Innes felt that a brochure should be furnished to <br />homeowners at the time of close of escrow reviewing the permit <br />process of the City. Mr. Harris said that several years ago, a <br />publication was offered to the public and stated perhaps it <br />should be done again. <br />Mr. Harris stated that this appeal will not go on to City <br />Council. The only thing that will go before them regarding this <br />matter is an appeal of a denial for an encroachment permit for <br />the portion of the wall in the public right of way. <br />GP-84-13, CALLAHAN-PENTZ PROPERTIES ET AL <br />Application of Callahan-Pentz Properties and Valley Memorial <br />Hospital for an amendment to the Land Use Circulation Element of <br />the General Plan to reconfigure the land use designation of the <br />approximately 61 acre site located at the northwest corner of <br />Santa Rita Road and West Las Positas Boulevard and to show a <br />northwest/southeast trending thoroughfare in that area. The <br />property is currently designated "Public and Institutional," <br />"Commercial and Offices" and "High Density Residential" on the <br />General Plan. These designations would remain but would be <br />reconfigured to some extent.
