Tom Gallagher, 789 Kottinger, felt that Mr. Herlihy's comments
were correct, but he felt the wall was very attractive and an
enhancement to the area. He did not feel it is a hazard. He
felt that it did not create a traffic problem and that traffic on
Abbie Street is going to decrease with the extension of Bernal
Avenue. He understands the City's point of view with regard to
the possible liability but did not feel that a hazard would
exist.
James Raar, Fairlands Drive, asked if sufficient property could
be deeded to Mr. Howe as this would reduce the City's liability
problem.
The public hearing was closed.
A motion was made by Commissioner Getty, seconded by Commissioner
Innes that the appeal of the Planning Commission concerning
PUD-79-11-5M be denied.
ROLL CALL VOTE
AYES• Commissioners Getty, Innes, Lindsey and
Chairman Doherty
NOES• Commissioner Wilson
ABSENT: None
ABSTAIN: None
Resolution No. 2544 was entered and adopted denying the appeal of
the Planning Commission relative to case PUD-79-11-5M.
Commissioner Innes felt that a brochure should be furnished to
homeowners at the time of close of escrow reviewing the permit
process of the City. Mr. Harris said that several years ago, a
publication was offered to the public and stated perhaps it
should be done again.
Mr. Harris stated that this appeal will not go on to City
Council. The only thing that will go before them regarding this
matter is an appeal of a denial for an encroachment permit for
the portion of the wall in the public right of way.
GP-84-13, CALLAHAN-PENTZ PROPERTIES ET AL
Application of Callahan-Pentz Properties and Valley Memorial
Hospital for an amendment to the Land Use Circulation Element of
the General Plan to reconfigure the land use designation of the
approximately 61 acre site located at the northwest corner of
Santa Rita Road and West Las Positas Boulevard and to show a
northwest/southeast trending thoroughfare in that area. The
property is currently designated "Public and Institutional,"
"Commercial and Offices" and "High Density Residential" on the
General Plan. These designations would remain but would be
reconfigured to some extent. A mitigated negative declaration of
environmental impacts will also be considered.
- 10 -
._.. _ _ _ _ _ __~r
