The Commission <br />agreed to these modifications. <br />MATTERS INITIATED BY COMMISSION MEMBERS <br />Commissioner Wilson appealed the decision of the Zoning <br />Administrator granting a modification to Cork Harbour's PUD to <br />allow the retention of the fence/wall structure of Mr. Howe on <br />Abbie Street. This matter will now be scheduled for public <br />hearings before both the Planning Commission and City Council. <br />Chairman Doherty asked if anyone in the audience had or knew <br />where to obtain a tricycle for an upcoming triathalon event for <br />heritage days. He has volunteered and has been unable to find <br />such a tricycle. <br />OLD BUSINESS - Public Hearings <br />UP-84-31 Kentucky Fried Chicken <br />Application of Kentucky Fried Chicken and Tancor Lease for <br />conditional use permit approval to allow for a drive-through <br />sales window and related facilities at an existing restaurant <br />located at 1$03 Santa Rita Road. Zoning for the property is PUD <br />(Planned Unit Development)-Central Commercial District. <br />Mr. Harris explained to the Commission that the Design Review <br />Board denied Kentucky Fried Chicken's application for design <br />review approval of building modifications earlier in the event. <br />The public hearing was opened. <br />Roger Hamblin, 9979 Mangoes, Hayward, indicated he had received a <br />copy of the staff report. He stated there would still be 18 <br />usable parking spaces if his request for modification was <br />granted. They would maintain the trellis and Wisteria plant. <br />The drive through will give better service to their customers. <br />Chairman Doherty stated that the restaurant never appears crowded <br />to him and asked the applicant if it is a profitable business. <br />Mr. Hamblin indicated that the business has made a profit this <br />year. <br />The public hearing was closed. <br />Commissioner Wilson asked how many parking spaces were required <br />for 52 seats and Mr. Harris responded that they must have 17 <br />parking spaces. <br />Commissioner Lindsey has looked at the building and understands <br />why the applicant would like to do something to improve the <br />- 2 - <br />
