City council is also considering a $5,000 penalty for every <br />tree destroyed or damaged in the opinion of the Director <br />of Public Works and Utilities. Council is attempting to <br />tighten up the Heritage Trees. <br />Chairman Doherty expressed a lot of concern with lack of <br />on-site supeevision during construction. He wants to see <br />a California Licensed Landscape Architect on the site <br />at all times during construction. <br />Commissioner Wilson expressed concern with a professional <br />being an the site and a tree dying anyway. Chairman Doherty <br />alluded'' to that and said he is very sensitive to trees and <br />perhaps there may be some litigation if a tree dies. He <br />felt strongly that even with a penalty being levied without <br />the right kind of supervision there can still be a problem. <br />Commissioner Innes then asked the Assistant City Attorney <br />about the penalties being assessed. Mr Swift explained <br />stating that currently there is no penalty at all assessed. <br />Commissioner Innes asked about the status of the railroad <br />consolidation.
