ROLL CALL VOTE <br />AYES: Commissioners Getty and Lindsey <br />NOES: Commissioners Innes, Wilson and Chairman Doherty <br />ABSENT: None <br />ABSTAIN: None <br />Commissioner Getty stated that Eucalyptus trees are tall <br />and narrow and would be appropriate for the site but. <br />didn't see how the Planning Commission could make this <br />type of judgment. <br />Commissioner Wilson then made a motion, seconded by Chairman <br />Doherty that the subject oak tree be removed, that appro- <br />priate landscaping be done on the site in accordance with <br />approval of staff, that the condition relating to the <br />"best efforts to save the tree" be eliminated from modifi- <br />cation approval, that three oak trees be planted on the site <br />and that a landscape plan be submitted for staff approval <br />concerning the location for the trees. <br />ROLL CALL VOTE <br />AYES: Commissioners Lindsey, Wilson and Chairman Doherty <br />NOES: Commissioner Getty and Innes <br />ABSENT: None <br />ABSTAIN: None <br />Resolution No. 2518 was entered and adopted recommending <br />approval of the modification for Deer Oaks as filed <br />under case PUD-82-13-2M. <br />Chairman Doherty again expressed concern that the updated <br />version of Protectin Shade Trees has not been ordered and <br />received. He again aske the staff to order these booklets <br />and make them available to all developers and homeowners <br />as appropriate. <br />Chairman Doherty asked Mr. Swift to comment on the action <br />taken by the City Council at their recent meeting concerning <br />Heritage Trees. <br />Mr. Swift stated that the City Council introduced an ordinance <br />stating that the Director of Public Works can require any <br />applicant to have a tree study for Heritage Trees. The City <br />can do this and be reimbursed by the developer. This would <br />put a tree expert on site. A report on the Heritage Trees <br />would be delivered to the City with the original applications <br />for development. The intent is to look at the Heritage trees <br />on site, review the condition of the trees and determine <br />what methods are needed to keep the tree living as well as <br />to determine which trees shall be removed if any. City council <br />is asking that the developers post a $5,000 per tree bond <br />with a $25,000 cap for the course of construction and for <br />a period of one year after project completion to ensure the <br />safety of Heritage trees. <br />-5- <br />
