8/8/84
Planning Commission
Page 7
The Assistant City Attorney stated that the City Council can't take action
without taking action on the negative declaration or EIR even if Planning
Commission wishes to recommend denial, there should probably be a motion
to recommend approval of the negative declaration for the application or
an EIR needs to be prepared.
The Commissioners felt that a land use change would have a significant impact
on the environment relating to noise of an office within a residential neighborhood
and the creation of spot zoning.
CommissionerWellman asked about the rezoning application before the Commission
with regard to this same property. Mr. Harris explained that the City Council
has already made the determination that rezoning and general plan amendment
would not have a significant environmental impact. They
have no intention of rezoning any other lands in the area.
A motion was made by Commissioner Innes, seconded by Commissioner Lindsey
that approval of case GP-84-3 would a significant effect on the environment
and that an EIR be prepared concerning this application.
ROLL CALL VOTE
AYES: Commissioners Innes, Lindsey, Wellman, Wilson
and Chairman Doherty
NOES: None
ABSENT: Commissioner Getty
ABSTAIN: None
Resolution No. 2506 was entered and adopted requesting that an EIR be prepared
for case GP-84-3, application of Cynthia Ostle as motioned.
RZ-84-11, City Council
Application of the City Council to rezone an approximately 10,000 sq. ft.
site from R-1-6500 (Single-family Residential) District to the PUD (Planned
Unit development)-Commercial District or to any other district consistent
with the General Plan.
