8/8/84 <br />Planning Commission <br />Page 7 <br />The Assistant City Attorney stated that the City Council can't take action <br />without taking action on the negative declaration or EIR even if Planning <br />Commission wishes to recommend denial, there should probably be a motion <br />to recommend approval of the negative declaration for the application or <br />an EIR needs to be prepared. <br />The Commissioners felt that a land use change would have a significant impact <br />on the environment relating to noise of an office within a residential neighborhood <br />and the creation of spot zoning. <br />CommissionerWellman asked about the rezoning application before the Commission <br />with regard to this same property. Mr. Harris explained that the City Council <br />has already made the determination that rezoning and general plan amendment <br />would not have a significant environmental impact. They <br />have no intention of rezoning any other lands in the area. <br />A motion was made by Commissioner Innes, seconded by Commissioner Lindsey <br />that approval of case GP-84-3 would a significant effect on the environment <br />and that an EIR be prepared concerning this application. <br />ROLL CALL VOTE <br />AYES: Commissioners Innes, Lindsey, Wellman, Wilson <br />and Chairman Doherty <br />NOES: None <br />ABSENT: Commissioner Getty <br />ABSTAIN: None <br />Resolution No. 2506 was entered and adopted requesting that an EIR be prepared <br />for case GP-84-3, application of Cynthia Ostle as motioned. <br />RZ-84-11, City Council <br />Application of the City Council to rezone an approximately 10,000 sq. ft. <br />site from R-1-6500 (Single-family Residential) District to the PUD (Planned <br />Unit development)-Commercial District or to any other district consistent <br />with the General Plan. The property is located at 1734 Santa Rita Road. <br />No action was taken on this case. See discussion in case GP-84-3 above. <br />GP-84-7, Chang Su-0 Lin <br />Application of Chang Su-0 Lin to amend the General Plan Land Use Element <br />designation of an approximately 5.2 acre site from Low Density Residential <br />to Medium Density Residential, located approximately 600 feet south of the <br />intersection of Kottinger Drive and Bernal Avenue. Zoning for the property <br />is PUD (Planned Unit Development)-Low Density Residential/Open Space District. <br />A negative declaration of environmental impacts will also be considered. <br />PUD-84-5, Chang Su 0-Lin <br />Application of Chang Su-0 Lin for rezoning and development plan approval <br />for a 224 unit residential development on an approximately 230 acre site <br />located generally in the area south of the southern terminus of Bernal Avenue, <br />Concord Street and Bordeaux Street. Zoning for the property is PUD (Planned <br />Unit Development)-Low Density Residential/Open Space District. A negative <br />declaration of environmental impacts will also be considered. <br />-7- <br /> <br />
