MINUTES <br />PLANNING COMMISSION <br />June 27, 1984 <br />Page 2 <br />Commissioner Wilson stated he did not see a condition in the staff report requiring that <br />the temporary structure be removed upon completion of the new-permanent structure. Mr. <br />Harris stated that the applicant would have to come before the Planning Commission with <br />the application for their new building and the temporary structure would be reviewed at <br />that time. <br />Commissioner Innes felt a four year period of time was a long one for a temporary conditional <br />use permit. Mr. Harris explained that the Bank of America on West Las Positas was granted <br />a temporary conditional use permit for five years and then was extended. This is not an <br />unprecedented situation. <br />The public hearing was opened. <br />Virgil Gass, Clorox, 7200 Johnson Drive, presented their proposal. Chairman Doherty asked <br />Mr. Gass if he had received a copy of the staff report. Mr. Gass acknowledged that he had <br />received the report and had no comments concerning it. <br />Commissioner Wilson stated that the landscaping appears to be minimal. Mr. Harris felt <br />the existing landscaping for Clorox is adequate, attractive and well maintained. The temporary <br />building would not be visible from Johnson Dr. Staff did not feel that a lot of added landscaping <br />was necessary at this time. He also indicated that on the south PT&T blocks the view of <br />the building from that direction. <br />Commissioner Innes asked about the colors for the permanent structure. Mr. Gass stated <br />they are not that far along with the site. They hope to have the building plans ready late <br />summer or early fall. The temporary building would house the new people hired until the <br />new building is designed and built. Scheduled completion is March 1985. Staff has been <br />kept aprised of their intentions and goals with regard to this project. <br />The public hearing was closed. <br />A motion was made by Commissioner Innes, seconded by Commissioner Wilson that case <br />Z-84-160 be approved subject to the conditions of the staff report, modifying condition number <br />two to reflect that approval will be only for a two year period with possible extension with <br />permission of the Planning Commission. Mr. Gass then stated that two years will not allow <br />the completion of the design documents and construction and asked if it could be extended <br />after the two year period. Commissioner Innes stated it is his intent to extend the approval <br />of the temporary structure for reasonable cause. He didn't want a temporary building ending <br />up to be a permanent one. Mr. Gass assured the Commission that they have every intention <br />of dismantling the old building upon construction of the new one. Chairman Doherty stated <br />that if Clorox was under construction, the Commission would grant an extension for the <br />temporary structure at the end of the two year time period. <br />ROLL CALL VOTE <br />AYES: Commissioners Innes, Wilson and Chairman Doherty <br />NOES: None <br />ABESNT: None <br />ABSTAIN: None <br />Resolution No. 2488 was entered and adopted approving case Z-84-16 as motioned. <br />-2- <br />
