MINUTES <br />PLANNING COMMISSION <br />6/13/84 <br />Page 10 <br />UP-84-18, Kentucky Fried Chicken <br />Application of Kentucky Fried Chicken and Tancor Lease for conditional use <br />permit approval to allow for a drive-through sales window and related facilities <br />at an existing restaurant located at 1803 Santa Rita Road. Zoning for the <br />property is PUD (Planned Unit Development)-Central Commercial District. <br />Mr. Harris presented the staff report indicating that the design of the proposed <br />physical changes was considered before the Design Review Board earlier and <br />denied. <br />The public hearing was opened. <br />Roger Hamblin, 9975 Mangos Drive, San Ramon, represented Kentucky Fried Chicken. <br />He presented a booklet to the Planning Commission shdwing the physical condition <br />of the shopping center area. Using the booklet he pointed out existing and <br />proposed trees, and landscaping etc. He stated the hedge is actually on the <br />property of the Shell service Station. The masonry wall is on the Kentucky <br />Fried Chicken property. He has talked to the owner of the Shell. Service station <br />and he has no problem with their proposal including the trimming of the hedge. <br />Concerning the width of the proposed drive-through, a large passenger car <br />would only use 9 feet and that would allow for the doors to be open. He doesn't <br />understand why the City feels 10 feet isn't enough. They need the <br />drive-through use to keep their business competitive. <br />Commissioner Lindsey asked why the Fire and Engineering Departments objected <br />to the 10' width. Mr. Hamblin responded that it has been indicated to him <br />that there would be a problem because of the size. He then referred to Jack <br />in the Box and MacDonalds drive-through areas. <br />Chairman Doherty asked the Assistant City Attorney about MacDonalds and the <br />Jack in the Box having a similar situation. The Assistant City Attorney indicated <br />that a use could be denied where safety is a factor and that the design of <br />the structure was considered at the Design Review Board stage earlier in the <br />evening. <br />CommissionerWilson felt the distance from the eastern side of Kentucky Fried <br />to the curb is a lot less than the other restaurants. He had concerns with <br />traffic problems. <br />Commissioner Innes pointed out that Jack in the Box is considerably wider at the exit than <br />this proposal and that the traffic exits into a parking lot then onto Valley <br />Avenue. The same thing is true of MacDonalds. Mr. Hamblin rebutted stating <br />that traffic is going less than one mile per hour. He stated there is 12 feet <br />from the building to the sidewalk. Regarding exiting, Mr. Hamblin stated that <br />there is a slow down lane before one gets into a heavy moving traffic lane. <br />They would like to help their business grow. <br />Earl Mattox, 5087 Hillcrest Circle, operates <br />didn't believe that approval of the use would <br />supported the application as presented. <br />he Shell service station.
