MINUTES <br />PLANNING COMMISSION <br />5/9/84 <br />Page 2 <br />There was no old business. <br />NEW BUSINESS -Public Hearings <br />Tract 5283, Clifford Preston <br />Application of Clifford Preston for tentative approval to subdivide an approximately <br />0.55 acre site into 9 townhouse units, common open area and related facilities at the <br />northeast corner of Mission and Dolores Drives. Zoning for the property is RM-25 <br />(Multi-family Residential) under application for rezoning to the PUD (Planned Unit <br />Development)-High Density Residential District. <br />Mr. Glenn presented the staff report recommending approval of the subdivision. <br />The public hearing was opened. <br />Ron Archer, 699 Peters Avenue, concurred with the staff report and urged the Commission's <br />approval. <br />Michael Price, 5256 Dolores Drive ,Townhouse Association President, stated he was <br />not aware of the hearing in March for approval of this project. He felt the development <br />would be over an acceptable height for the downstairs level. He did not receive the <br />notice of the previous hearings as they were addressed to another person. Vice Chairman <br />Wilson indicated he has had problems with the Post Office and receiving his own mail. <br />Mr. Glenn indicated that Mr. Price had contacted him recently and he attempted to <br />get the applicants and Mr. Price together in an effort to have Mr. Price's concerns <br />minimized but this case has gone before the City Planning Commission and Council <br />on three separate occasions. Mr. Price stated that the notice was mailed to A. Pleasant <br />at his address and until recently he forwarded that mail on. Vice Chairman Wilson <br />indicated that this property has been zoned for this type of development since 1963 <br />and that the change in the zoning at this time only makes a condominium possible <br />and has nothing to do with the multiple structure for the site. It was always intended <br />that atwo-story multi residential structure would be on this site. He then asked Mr. <br />Price if his concern is that he will not be able to see the hills. Mr. Price indicated <br />that this is his concern. Mr. Swift indicated that this project conforms to the PUD <br />and the entire project would have to be readdressed to change the plan. The only action <br />the Planning Commission can take is to approve it if it conforms to the PUD or not <br />to approve it. Commissioner Lindsey stated that we have taken every reasonable and <br />legal effort to make sure all of the people have been notified. <br />Mr. Warnick indicated he would like to highlight condition number five for the information <br />of the applicant and others regarding separate sanitary sewer lateral. <br />The public hearing was closed. <br />A motion was made by Commissioner Lindseyseconded by Commissioner Getty that <br />Tract 5283 conforms to the PUD zoning and that it be approved subject to the conditions <br />of the staff report. <br />ROLL CALL VOTE <br />AYES: Commissioners Getty, Lindsey and Vice Chairman Wilson <br />NOES: None <br />ABSENT: Chairman Doherty <br />ABSTAIN: None <br />Resolution No. 2464 was entered and adopted approving Tract 5283 as motioned. <br />.. _..._.__._. __. _ ._ . _ .._ .,-__ _ ___. r <br />
