MINUTES <br />PLANNING COMMISSION <br />Page 7 <br />A motion was made by Commissioner Doherty, seconded by Commissioner Lindsey that <br />project approval may have a significant impact on the environment but that conditions <br />imposed on project approval would reduce the potentially significant impact to an <br />insignificant level and that a mitigated negative declaration be adopted. <br />ROLL CALL VOTE <br />AYES: Commissioners Doherty, Getty, Lindsey, Wilson and Chairman Jamieson <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />Resolution No. 2434 was entered and adopted recommending approval of a mitigated <br />negative declaration. <br />A motion was made by Commissioner Doherty, seconded by Commissioner Wilson that <br />case PUD-83-17 be recommended for approval subject to the conditions shown on the <br />staff report with the following changes: Condition No. 1 shall reflect that the <br />development shall be as shown on the development plan and not "substantially as <br />shown" on file with the Planning Division except that the number of units shall <br />be reduced from 46 to 40 and this reduction shall be accomplished by converting <br />the six-plex on the northwest corner of the property to a four-plex and the eight-plex <br />on the southwest corner of the site to a four-plex; Condition No. 2 that prior to <br />issuance of a building permit, plans for all fencing on the site shall be submitted <br />to the Planning Division for approval. In addition to the fencing shown on the <br />development plan, a minimum 6 ft. high solid wooden fence shall be constructed along <br />the entire length of the western property line of the subject property, exclusive <br />of the setback and a 6 ft. high masonry fence shall be constructed along the entire <br />eastern property line exclusive of setback. This fence shall be installed and terraced <br />and shall be a minimum of 6' in height above the lowest point on the property ad'oining <br />the Mavis Street residences.: Condition No. 5 that the Mavis Street residents shall <br />have the opportunity to have input in the preparation of the CC&Rs; Condition No. <br />11 shall be renumbered to Condition No. 13: Condition No. 11 added, "Minimum rear <br />setback of the attached homes on the east side of the property line shall be 35'; <br />Condition No. 12 that because the project will create unacceptable traffic levels <br />on Vineyard Avenue just east of First Street, no grading or building permits shall <br />be issued for any portion of the project until construction has commenced on all <br />improvements necessary to connect Valley Avenue to Bernal Avenue; and relating to <br />Standard Conditions of Development, conditions number 22, 23 and 51 shall have the <br />Mavis Street property owners included in the review of colors and landscape plans <br />as therein described. <br />ROLL CALL VOTE <br />AYES: Commissioners Doherty, <br />NOES: Commissioner Getty <br />ABSENT: None <br />ABSTAIN: None <br />Lindsey, Wilson and Chairman Jamieson <br />Resolution No. 2435 was entered and adopted recommending appro~,al of caes PUD-83-17 <br />as motioned. <br />-7- <br />
