MINUTES <br />PLANNING COMMISSION <br />Page 4 <br />Mr. Garrigan asked that the following conditions be amended: <br />Condition No. 1 - to reflect that the development will be as shown on <br />(changed) the development plan... and not substantially as shown. <br />Condition No. 2 - That the fencing be installed and terraced and be a minimum <br />(add) 6' in height from the lowest point on the property adjoining <br />the Mavis Street residences. <br />Condition No. 5 - That the citizens have input to the CC&Rs to ensure <br />(add) that a capital improvement trust account is established. <br />Add - That the minimum rear setback of the attached homes <br />on the east side of the property line shall be 35'. <br />Standard Conditions <br />Condition No. 22- That the Mavis Street residents be included so that <br />(add) they may review the final landscape plan for the development. <br />Condition No.23 - That the Mavis Street residents be included so that <br />(add) they may review the final colors of the buildings. <br />Condition No. 51- That the Mavis Street residents be included in the review <br />(add) of the final detailed landscape and irrigation plans. <br />He also expressed concern with standard Condition No. 7 regarding the construction <br />of the street. Mr. Warnick explained that while it will be private, it will <br />be constructed in a manner similar to a public street. <br />Commissioner Getty asked Mr. Garrigan if they had a homeowners association <br />in their area. Mr. Garrigan stated no they do not have nor do they have CC&Rs <br />covering their development. He indicated they police themselves and all <br />of their problems pretty much get resolved by neighborhood communication. <br />Commissioner Getty expressed some concern about adding the wording proposed <br />by Mr. Garrigan and then having the residents on Mavis move. Mr. Garrigan <br />stated that the developer has no objections to their proposal. <br />Mr. Swift indicated that the Commission could refer to the 'neighbors on Mavis <br />Drive' and this would take care of the matter. <br />Commissioner Lindsey asked Mr. Baldacci if they agree to the request <br />of Mr. Garriagan. Mr. Baldacci indicated that they do. <br />Donna Graves, 419 Mavis Drive, is a next door neighbor of Howard Garrigan. <br />She stated that the developer has been cooperative with all of the neighbors. <br />She indicated that with the reduction of the six units, they have no problem <br />with the density. Their concerns relate to parking and Mr. Baldacci is <br />taking care of this.
