Minutes <br />Planning Commission <br />1/25/84 <br />Page 8 <br />Mr. Swift stated that persons within 100 feet would require notification in the event <br />of a public hearing and not 300 feet as is done now. <br />After discussion, the Planning Commission initiated an application to change the <br />Zoning regulations with regard to childcare in residential neighborhoods and opened <br />the public hearing. <br />No one addressed the proposed ordinance and the public hearing was closed. <br />A motion was made by Getty, seconded by Commissioner Lindsey that an ordinance <br />be drafted providing for administrative review of daycare applications according <br />to the basic standard that such operations be separated by three hundred feet from <br />any other childcare facility; where an applicant's home is closer than three hundred <br />feet to another childcare facility, as provided for under state law, a maximum of <br />six children (including those residing in the home) could be cared for. <br />ROLL CALL VOTE <br />AYES: Commissioners Doherty, Getty, Lindsey and <br /> Chairman Jamieson <br />NOES: Commissioner Wilson <br />ABSENT: None <br />ABSTAIN: None <br />Resolution No. 2424 was entered and adopted recommending approval of case RZ-84-1 <br />as motioned. <br />UP-82-24 James Cross & Texaco, Inc. <br />One year review of a conditional use permit to operate a service station not including <br />the sale of gasoline at 44 Mission Drive. Zoning for the property is C-F (Commercial <br />Freeway) District. <br />Mr. Harris presented the staff report stating that Mr. Cross has complied with all <br />of the conditions imposed on his use permit and that the business has been run in <br />a clean and orderly way, including the maintenance of landscaping and surrounding <br />areas. <br />Commissioner Wilson felt that this application should be reviewed once a year. <br />It would be particularly important if the business were to change hands. Mr. Harris <br />stated that the purpose of the one year review was so that the Planning Commission <br />would have the ability to add, delete, or modify conditi ons of the use permit at <br />that time. <br />Commissioner Getty didn't feel that Mr. Cross should have to come back before <br />the Planning Commission every year. Commissioner Lindsey felt that this business <br />should be allowed to continue for the duration of the use permit (3 additional) years <br />as long as Mr. Cross is the owner/operator. Chairman Jamieson supported a yearly <br />view as stated by Commissioner Wilson. <br />Jim Cross, 821 Sylvaner, stated that he is operating his business in accordance with <br />the conditions imposed on his use permit and stated that as far as he knows, no other <br />business in town must have a yearly review. He stated he plans to make his career <br />this business and with a yearly review there is always the possibility the conditional <br />use permit could be revoked. He didn't feel this was fair. <br />-8- <br /> <br />
