Minutes <br />Planning Commission <br />1/25/84 <br />Mrs. Swank asked the Commission if it was okay if from time to time she could <br />watch children on the weekends and/or evenings. She said her license for six allows <br />her this flexibility. Chairman Jamieson said he didn't feel this would be a problem <br />if there are not over six in the evening. Mrs. Swank indicated she did not intend <br />to have six children in the evening. <br />Chairman Jamieson asked where the children would be in inclement weather. Mrs. <br />Swank said she has a large family room which can accommodate 12 children. They <br />intend to fix up the garage if it meets with the approval of the State, County, Fire <br />Department, etc. so that they can ride their bicycles and have active play during <br />bad weather. <br />Chairman Jamieson then asked staff about the new State law which just went into <br />effect governing childcare in residentially zoned areas. Mr. Harris explained and <br />stated this would be the topic of the next item on the agenda. <br />Mr. Jack Hovingh, 4250 Muirwood Drive, spoke in support of this application in view <br />of the all of the industrial growth in the City. <br />Chairman Jamieson then asked who is responsible for inspecting the premises when <br />the children are cared for. Mr. Harris stated that it was either the State or County. <br />Commissioner Lindsey stated that he had no problem with recommending 7:OOam <br />starting hours for the applicant. <br />The public hearing was closed. <br />A motion was made by Commissioner Getty, seconded by Commissioner Doherty <br />that all findings as shown in the staff report are made and that case UP-83-61 be <br />approved subject to the conditions shown in that staff report and that Condition <br />No. 4 be changed to reflect the hours of 7:OOam - 6:OOpm rather than 7:30am - 6:OOpm. <br />ROLL CALL VOTE: <br />AYES: Commissioners Doherty, Getty, Lindsey, Wilson and <br /> Chairman Jamieson <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />Resolution No. 2423 was entered and adopted approving case UP-83-61 as motioned. <br />RZ-84-1, City of Pleasanton <br />Application of the City of Pleasanton to amend the Zoning Ordinance with respect <br />to the regulation of home daycare facilities for children in residential areas. The <br />Planning Commission may recommend any action on this matter consistent with <br />the General Plan. <br />Mr. Harris presented the staff report. Mr. Swift reviewed the types of regulations <br />which can now be put on daycare facilities in residential neighborhoods. He stated <br />that a public hearing on each application would no longer be necessary in view of <br />new State law. He stated that the applicant or neighbor could request a public hearing <br />and this public hearing would go before the Zoning Administrator if held and not <br />the Planning Commission. <br />-7- <br />..._ _ _ _ T <br />
