Minutes <br />Planning Commissic <br />November 13, 1985 <br />RZ-85-16, City of Pleasanton <br />Application of the City of Pleasanton to amend the Ordinance Code <br />of the City of Pleasanton to ban skateboard ramps in residential <br />districts. <br />Mr. Swift presented the staff report recommending approval of <br />this application. <br />The public hearing was opened. <br />Roger Manning, 1078 Vintner Way, urged denial of this proposed <br />Ordinance Code amendment. Skateboarding is an excellent sport <br />with positive benefits. If there is a problem in a particular <br />neighborhood, then it should be addressed at that level. He did <br />not feel that the Code should be amended to address it. Swimming <br />pools in backyards cause as much noise as skateboard ramps as do <br />tennis courts, spas, basketball courts, etc. To approve this <br />change would be to cause an erosion of property rights. Mr. <br />Manning has asked the Park and Recreation Commission to schedule <br />a hearing on this; however, he didn't feel positive with the <br />possible results because there are overriding liability problems. <br />He is aware of seven substantial ramps in Pleasanton and he is <br />sure there are many others. Chairman Wilson asked Mr. Manning <br />whether or not he had a skateboard ramp in is backyard. Mr. <br />Manning stated he has one in his backyard. He has only had one <br />complaint and has appeased the neighbors by arranging hours in <br />which the children can use it along with lining it with masonite. <br />He also indicated he and his neighbors are still friendly. <br />Chairman Wilson pointed out that the skating rink at the <br />Fairgrounds is closed because of no insurance availability. He <br />understands others are closing also. <br />Tom Olson, 3758 West Las Positas Boulevard stated that prior to <br />July he lived on Northway Drive which had a skateboard ramp right <br />next door. He endorsed Mr. Mannings comments in opposition to <br />the ban of skateboard ramps. He suggested that if he complained <br />about the noise created by his neighbors using a hot tub, there <br />would be a very large group in the audience. He took issue with <br />the staff report and didn't feel that a neighborhood problem <br />could be solved by changing the zoning laws. He felt that to ban <br />skateboard ramps in residential areas would violate his property <br />rights. If there was an alternative such as a park, then perhaps <br />it would be a completely different situation. <br />The public hearing was closed. <br />Chairman Wilson felt property owners are also entitled to peace <br />and quiet and could not support the use of skateboard ramps in <br />residential areas. <br />Commissioner Innes felt there are noise and nuisance ordinances <br />on the books which can deal with offensive situations and felt <br />those ordinances should be implemented. <br />- 5 - <br />_ ..,.. ~.. __._._ _ _ _ T <br />
