Minutes <br />Planning Commissio <br />September 25, 1985 <br />Tom Byrnes, Hopyard Partners, stated they have several uses which <br />are open late, i.e, Popi Lounge, coffee shop and the ice cream <br />store. They are proposing closing off the parking lot on the <br />east side of because of the impact of the Popi Lounge on the <br />neighbors. That was the only practical solution arrived at. <br />They feel they have sufficient parking because many of the users <br />are closed in the evening. This application requires their <br />employees to park in the canal parking areas thus reducing the <br />use of the parking lot by 35 to 50 people. They will receive one <br />warning; if they do not abide by this, they will be towed. <br />Vice Chairman Lindsey asked Mr. Byrnes if they have read the <br />staff report. Mr. Byrnes indicated that they have and agree with <br />the conditions recommended. They have met with the neighbors and <br />have tried to mitigate all of their concerns as well as those of <br />the staff. They agree 100% with all of the conditions. Further, <br />the tenants of the center were invited to attend the many <br />meetings. <br />Vice Chairman Lindsey asked about the relationship of Mr. Byrnes <br />and his tenants. Mr. Byrnes indicated that their relationship is <br />excellent. Vice Chairman Lindsey stated he found it <br />inconceivable that the retail business would close at 7:OOpm. <br />Mr. Byrnes indicated that they committed the gate to the <br />neighbors and do not feel that it should ever be taken away. He <br />explained that they went to court on an unlawful detainer and <br />were unsuccessful against the Popi Lounge. <br />Commissioner Michelotti asked if Mr. Byrnes considered office <br />space. Mr. Byrnes indicated that even offering temporary free <br />rent and office space at 75 cents a square foot they cannot rent <br />out the second story office space available in the existing <br />shopping center. <br />Ronald Pozebon, 2808 Longspur Drive, was against the project and <br />rezoning request. He felt the parking was being increased, not <br />reduced as promised by the City Council. Further there is a real <br />problem with a live band at Popi Lounge on Friday nights. All <br />efforts to reduce the noise levels even by the Police Department <br />have failed. He felt parking lot lighting would be a problem as <br />there is already too much lighting from the sports park. He also <br />had concerns with potential vandalism, and dirt during the course <br />of construction. <br />The public hearing was closed. <br />Commissioner Innes expressed concern with the use of the building <br />for La Petite Academy should that use not be successful. He <br />pointed out that Council Members and Planning Commissioners <br />change. He couldn't support this application. <br />Vice Chairman Lindsey had a problem with the control gate in the <br />area. He can support what has been presented by the applicant <br />but was in favor of limiting the use to office only. He also <br />would like to see the future 7,000 sq. ft. office building <br />- 3 - <br /> <br />
