Minutes <br />Planning Commissio. <br />September 25, 1985 <br />Vice Chairman Lindsey asked if the developer built out the <br />project as now allowed whether or not the hill would be visible. <br />Mr. Swift indicated it would not be seen very much. <br />Commissioner Lindsey stated that the major impact on the area so <br />far has been Falcon Development. He asked whether or not the <br />impacts had ever been addressed. Mr. Swift explained that the <br />development is for a custom lot PUD and these lots were shown on <br />the tentative and final maps. Sometime during the improvement <br />approval stage, pads were cut on these lots which makes it almost <br />impossible to put homes on them without additional grading. <br />The public hearing was opened. <br />John Van DeRoovaart, 4300 Del Valle Parkway, stated that he and <br />Mr. Gooch own 16 lots, five of the lots have a 15' setback and no <br />usable backyard. They have three of the lots sold based upon the <br />outcome of the approval of their application. Mr. Van DeRoovaart <br />discussed the tree report. They had previously thought two large <br />oak trees would have to be removed but the tree report states <br />that three are diseased. Also they have pictures and renderings <br />of houses similar to what they propose to build for the <br />Commission's perusal. <br />Chairman Lindsey asked if the applicant has reviewed the staff <br />report and whether or not they agree to the conditions shown <br />thereon. Mr. Van DeRoovaart indicated they have no problems with <br />it and urge that their application be approved. <br />Commissioner Wellman asked if based upon the tree report <br />indicating the disease of three trees if the third lot would have <br />the same amount of grading as proposed for the other lots. Mr. <br />Gooch indicated the grading would be a little more than shown on <br />the plan but would still conform to Lot No. 81 which is located <br />next door and which they do not own. Further because of the tree <br />report and the findings with regard to tree disease if they do <br />not remove the three trees, they are liable for damages caused by <br />the diseased trees. <br />Commissioner Michelotti asked where the developer proposed to <br />take the removed fill. Mr. Gooch indicated that some would go on <br />site, in the front of the lots, and the other would go on Stanley <br />Boulevard. If there is additional, they would take it to Kaiser. <br />Commissioner Michelotti asked if the trucks could be covered when <br />hauling the fill. Mr. Gooch stated that the trucks can be <br />watered and covered. Commissioner Michelotti indicated that when <br />a truck is covered which hauls fill, it reduces the negative <br />impacts on the areas in which they travel. Commissioner <br />Michelotti asked about the present fencing. Mr. Gooch said it <br />would remain and then the terrain would be gradually graded. <br />Commissioner Innes discussed the approved grading plan. Mr. <br />Gooch indicted that the approved grading plan is not as the area <br />exists. <br />- 11 - <br />
