Minutes <br />Planning Commissio <br />September 11, 1985 <br />RZ-85-14, City of Pleasanton <br />Application of the City of Pleasanton to amend the Ordinance Code <br />to establish satellite dish antennae standards for their design <br />and use. <br />Mr. Swift presented the staff report recommending approval of the <br />proposed ordinance. <br />Commissioner Inner worked on this proposed ordinance with staff <br />and asked that Item b(2) be clarified to show that the first <br />alternative would be to locate satellite earth stations on the <br />roof with the last alternative to be next to a building. <br />Chairman Wilson discussed a(2) and asked what would happen on the <br />large lots in the Foothill Road area where there is no solid <br />fencing. Mr. Innes then explained the intent. Screening would <br />have to be done acceptable to the Planning Director. Mr. Swift <br />stated that it would be the intention to have staff try to work <br />with each individual application on its own merit. It is not the <br />intention to have anybody have to go out and pay a large amount <br />of money for trees for instantaneous screening. Commisisoners <br />commented that if one could afford such an antenna, one could <br />afford screening plants and materials of sufficient size. <br />The public hearing was opened. <br />Ron Kane, 3679 Canelli Court, had concerns with the definition. <br />He didn't feel 'earth station' is specific. With this definition <br />public service antennas used for other purposes would be <br />regulated and he didn't feel that this was the City's intent. He <br />indicated that the FCC has made a statement they would preempt <br />local ordinances if they were presented for any other reason than <br />aesthetics or public safety. Mr. Kane then discussed technical <br />aspects with Commissioner Inner. After discussion he urged that <br />the Commission give thought to the size they wish to regulate. <br />With an unclear regulation one could eliminate flat antennas. <br />Commissioner Lindsey told Mr. Kane that the City is trying to <br />put together a general ordinance relating to aesthetics and in no <br />way trying to write a technical ordinance. <br />Commissioner Innes stated the regulation would apply to <br />commercial dish with two-way satellite connections. This was <br />developed because of the need to control residential and <br />commercial use based on today's technology. It was never <br />intended to cover every aspect of the field. <br />Commissioner Inner stated that the FCC statement indicated they <br />would not preempt local ordinances if public hearings were used <br />for adoption. <br />Mr. Kane expressed interest in making sure the ordinance is <br />directed to the appropriate segment of the satellite users and <br />pointed out that he has never seen a notice relating to a <br />rescinded ordinance. Commissioner Inner told Mr. Kane that the <br />Commission has a responsibility to try to plan the community. <br />- 10 - <br /> <br />
