Minutes
Planning Commission
August 28, 1985
would suggest eliminating Condition No. 4 and adding a sentence
to Condition No. 3 covering this. Commissioner Innes agreed with
Commissioner Lindsey but would go one step further and state that
just because this business is for "educational" photography does
not mean it is not a retail-commercial operation. Commissioner
Lindsey said he would like to hear from the applicant.
Commissioner Innes also asked staff to address storage of
hazardous materials with this use. Mr. Swift stated that the
applicant has indicated there would not be too much development
on the site and this area of concern is under the jurisdiction of
the Fire Department.
The public hearing was opened.
Charles Leeb, owner of School Pictures, Inc, stated that 99% of
his business is in the field. They are basically a distribution
center at California Avenue. They receive a large number of
fliers, currency envelopes, etc. at this location for
distribution. The only settings they do for students at this
location would be make up school pictures for perhaps year books
when a child is not at school at the time pictures are taken.
They actually go to the school three or four times prior to this
aspect of the business even happening. The dark room would be
for emergency situations only and the materials are not hazardous
whatsoever. They are obligated to process all pictures through
Pictures Incorporated as they are a franchise of this company.
Mr. Leeb stated that the photographers are on the road and
typically keep equipment with them.
Commissioner Hoyt asked Mr. Leeb if he would be crowding 50
sittings. Mr. Leeb indicated he would not.
The public hearing was closed.
Commissioner Lindsey reiterated that he would like Condition No.
4 eliminated and No. 3 added to as follows:
"...except on an emergency basis for educational sittings.
(Emergency educational settings are not to exceed 50 in one
year) . "
A motion was made by Commissioner Lindsey, seconded by
Commissioner Hoyt that all findings as shown in the staff report
re made and that Case UP-85-33 be approved subject to the
conditions shown in the staff report with the elimination to No.
4 and addition to No. 3 as previously stated.
ROLL CALL VOTE
AYES:
NOES:
ABSENT:
ABSTAIN:
Commissioners Hoyt,
and Chairman Wilson
None
None
None
Innes, Lindsey, Wellman
- 6 -
.. f
