Minutes <br />Planning Commission <br />August 28, 1985 <br />would suggest eliminating Condition No. 4 and adding a sentence <br />to Condition No. 3 covering this. Commissioner Innes agreed with <br />Commissioner Lindsey but would go one step further and state that <br />just because this business is for "educational" photography does <br />not mean it is not a retail-commercial operation. Commissioner <br />Lindsey said he would like to hear from the applicant. <br />Commissioner Innes also asked staff to address storage of <br />hazardous materials with this use. Mr. Swift stated that the <br />applicant has indicated there would not be too much development <br />on the site and this area of concern is under the jurisdiction of <br />the Fire Department. <br />The public hearing was opened. <br />Charles Leeb, owner of School Pictures, Inc, stated that 99% of <br />his business is in the field. They are basically a distribution <br />center at California Avenue. They receive a large number of <br />fliers, currency envelopes, etc. at this location for <br />distribution. The only settings they do for students at this <br />location would be make up school pictures for perhaps year books <br />when a child is not at school at the time pictures are taken. <br />They actually go to the school three or four times prior to this <br />aspect of the business even happening. The dark room would be <br />for emergency situations only and the materials are not hazardous <br />whatsoever. They are obligated to process all pictures through <br />Pictures Incorporated as they are a franchise of this company. <br />Mr. Leeb stated that the photographers are on the road and <br />typically keep equipment with them. <br />Commissioner Hoyt asked Mr. Leeb if he would be crowding 50 <br />sittings. Mr. Leeb indicated he would not. <br />The public hearing was closed. <br />Commissioner Lindsey reiterated that he would like Condition No. <br />4 eliminated and No. 3 added to as follows: <br />"...except on an emergency basis for educational sittings. <br />(Emergency educational settings are not to exceed 50 in one <br />year) . " <br />A motion was made by Commissioner Lindsey, seconded by <br />Commissioner Hoyt that all findings as shown in the staff report <br />re made and that Case UP-85-33 be approved subject to the <br />conditions shown in the staff report with the elimination to No. <br />4 and addition to No. 3 as previously stated. <br />ROLL CALL VOTE <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br />Commissioners Hoyt, <br />and Chairman Wilson <br />None <br />None <br />None <br />Innes, Lindsey, Wellman <br />- 6 - <br />.. f <br />
