Zoning for the property is
PUD (Planned Unit Development)-Commercial and Offices District.
Mr. Swift presented the staff report indicating that this
application is to set a standard for uses in the shopping center.
Commissioner Michelotti then discussed 'take out' food and
whether or not a Chinese restaurant which occasionally packages
food to go would be considered a fast food restaurant. Mr. Swift
explained that it would not be considered a fast food restaurant.
The public hearing was opened.
John Ferreri, 865 Abbie Street, the applicant, stated that
Exhibit "B" of the staff report is a copy of the uses approved
for the shopping center under a separate PUD. They have promised
the neighbors not to have liquor stores or convenience markets
and fast food stores in the center. It was understood that a
pizza and Chinese restaurant which allows take out food along
with their regular restaurant would be allowed in the center. He
asked that video stores be a "permitted" in lieu of a
"conditional" use as indicated in staff's recommendation.
Commissioner Michelotti asked the hours of operation a video
store would have. Mr. Ferreri said they would probably close
around 10:00pm. The developers have agreed to no all night uses
on the property. Staff indicated there is no problem in having
vide stores a permitted use in the center.
Mr. Ferreri then asked that the following changes to staff's
recommended uses be made:
Permitted uses to be added:
Antique stores
_ g _
.~
