Minutes <br />Planning Commissioi <br />June 26, 1985 <br />ROLL CALL VOTE <br />AYES: Commissioners Innes, Lindsey, Michelotti, <br />Wellman and Chairman Wilson <br />NOES: None <br />ABSENT: Commissioner Hoyt <br />ABSTAIN: None <br />Resolution No. 2665 was entered and adopted approving Case <br />UP-85-17 as motioned. <br />UP-85-19, Prudential Insurance Company <br />Application of the Prudential Insurance Company for conditional <br />use permit approval to operate an interim heliport for private <br />use on a portion of an approximately 2.3 acre site located on the <br />southeast corner of Owens Drive and Chabot Drive. Zoning for the <br />property is IG (General Industrial) District. <br />This matter was continued to 7/24/85. <br />MATTERS FOR COMMISSION'S REVIEW <br />TENTATIVE MAPS <br />Tract 5508,Equity Enterprises <br />Application of Equity Enterprises for tentative subdivision map <br />approval for a 10 lot condominium townhouse development on the <br />approximately 2.6 acre site located at 4005 Stanley Boulevard. <br />Zoning for the property is PUD (Planned Unit Development)-High <br />Density Residential District. <br />Mr. Swift presented the staff report recommending approval of the <br />requested subdivision. Commissioner Innes asked about common <br />area maintenance. Mr. Swift explained that this project is just <br />like an air space condominium. Commissioner Innes then asked <br />about Engineering conditions number 5 and 8. He didn't feel that <br />with regard to number 8 relating to a water meter that the <br />condition was applicable to this development. <br />The public hearing was opened. <br />George Spiliotopoulos, the applicant, stated that eventually the <br />project would become one lot of record. Mr. Okamura suggested <br />that the phrase "as otherwise approved by the City Engineer" <br />covers the concerns expressed. <br />Chairman Wilson discussed the CC&Rs and stated the City always <br />requires them but when there is a violation of the CC&RSs, they <br />are not enforced. For example, if a person starts construction <br />and quits, the City does not take any action. Mr. Swift stated <br />that condominium CC&Rs are reviewed by the City. The City has <br />the right to enforce them with regard to maintenance of the <br />structures and landscaping. CC&Rs for single-family residential <br />tracts do not require City approval. <br />- 4 - <br />
