AYES: Commissioners Hoyt, Innes, Lindsey, Wellman and <br />Chairman Wilson <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />Traffic Assumptions <br />This matter was continued to 6/26/85. <br />TENTATIVE MAPS <br />Tract 5371, McBail Company <br />Application of the McBail Company for tentative map approval to <br />subdivide an approximately 8.8 acre site located at 3472 Vineyard <br />Avenue into seven separate parcels to facilitate construction of <br />an 80 unit condominium complex and a City park. Zoning for the <br />property is PUD (Planned Unit Development)-High Density <br />Residential and "A" (Agricultural) District. <br />Tom Quaglia presented the staff report recommending approval of <br />Tract 5371 subject to the conditions shown in the staff report <br />adding "That the developer meet all applicable conditions or <br />requirements of other City departments and/or any interested <br />outside public agencies having jurisdiction as determined by the <br />City Engineer." Commissioner Innes asked for an explanation of <br />the subdivision with seven distinct parcels. He also asked if <br />the improvements had to be done for the entire seven lots. Mr. <br />Quaglia stated that the improvements have to be completed with <br />the first phase. However, they will have to have another map for <br />the remaining five parcels. Mr. Harris explained that this <br />project has a long term agreement covering 40 units. <br />The public hearing was opened. <br />Mike Gallagher, McBail and Company, Stone Valley Road, Alamo <br />presented their proposal. The subdivision includes units within <br />one building without having to be enclosed in all of the <br />buildings. This is required by the Department of Real Estate. <br />They have read the conditions. He asked about Condition No. 5 in <br />PUD-84-13 regarding the fencing between the park and their <br />property. Mr. Harris indicated that any change to this condition <br />would be subject to a PUD modification. Mr. Gallagher wanted it <br />a matter of record that they do not want a wrought iron fence <br />next the pool are, etc. They will ask for a wall to replace the <br />wrought iron fence. Chairman Wilson asked who would pay for such <br />a wall. Mr. Gallagher indicated that McBail would pay. Mr. <br />Gallagher asked about Condition NO. 19 of PUD-84-13 and Condition <br />No. 37 of the engineering conditions covering the tentative map. <br />There is no dollar amount mentioned concerning the sanitary sewer <br />and did not particularly like an open ended commitment. He asked <br />for some idea of the cost. <br />Mr. Okamura then reviewed the <br />eastern area. Mr. Gallagher <br />relationship to the park and <br />sewerage and drainage plan for this <br />addressed condition No. 38 with <br />asked that staff confirm that it <br />- 11 - <br />
