Minutes <br />Planning Commission. <br />3/27/85 <br />(Public and Institutional) District to the <br />(Single-family Residential) District or to <br />district consistent with the General Plan. <br />located on the north side of Crellin Road, <br />the residences on the east side of Sylvaner <br />southeast of Chardonnay Drive . <br />This matter was continued to May 8, 1985. <br />RZ-85-8, City of Pleasanton <br />Application of the City of Pleasanton <br />Ordinance to reduce exterior side yard <br />requirements. <br />Mr. Harris presented the staff report <br />the application. He proposed that the <br />modified somewhat for clarity. <br />R-1-6500 <br />any other zoning <br />The property is <br />immediately east of <br />Drive and 600 feet <br />to amend the Zoning <br />fence setback <br />recommending approval of <br />draft ordinance be <br />Commissioner Innes asked about the recent variance requests for <br />encroachments into the sideyard setbacks. Mr. Harris explained <br />this recent application was denied, appealed to City Council <br />where it was denied. Enforcement of the denial has been put in <br />abeyance for the results of the proposed ordinance change. <br />Commissioner Innes asked if violators of the current code would <br />be grandfathered in. Mr. Swift explained that if the change is <br />approved it effects everyone. <br />Commissioner Lindsey asked if the staff is following through with <br />the developers concerning installation of fences in residential <br />districts. Mr. Harris explained that this is now being addressed <br />at tentative map stage. Commissioner Lindsey then asked about <br />single homes being built and how their fencing is governed. Mr. <br />Harris explained that building permits are not required for <br />fences six feet or less in size and therefore it is difficult to <br />monitor fence construction, but the building department is <br />keeping an eye out as they inspect the homes. The problem with <br />this is that homes are generally finalled for occupancy prior to <br />the construction of fences. <br />The public hearing was opened. <br />Kay Daniels, 2706 Corte Bandera urged approval of this ordinance <br />code change. She stated it would allow her privacy and reduce <br />landscape maintenance. <br />John Peterson, 6190 Corte Del Rey, urged approval of the <br />ordinance code change. His fence is currently within a 5 foot <br />setback, and is quite attractive. He stated that a variance for <br />his fences was denied and the ordinance code change would allow <br />his fence to exist as it is currently constructed. <br />The public hearing was closed. <br />Commissioner Lindsey stated that the ordinance code change make <br />sense to him. He believes five feet vs ten feet is appropriate <br />and and would allow better landscaping maintenance of areas. <br />- 4 - <br />
