Minutes <br />Planning Commission <br />March 13, 1985 <br />Commissioner Getty liked the proposal. Chairman Doherty hoped <br />that this project would be better than the Shea Homes project in <br />the area. <br />A motion was made by Commissioner Getty, seconded by Commissioner <br />Wellman that the negative declaration prepared for Case PUD-85-1 <br />be recommended for approval inasmuch as approval of this project <br />would have an insignificant effect on the environment. <br />ROLL CALL VOTE <br />AYES: Commissioners Getty, <br />Chairman Doherty <br />NOES: None <br />ABSENT: Commissioner Innes <br />ABSTAIN: None <br />Lindsey, Wellman, Wilson and <br />Resolution No. 2625 was entered and adopted recommending approval <br />of the Negative Declaration prepared for Case PUD-85-1. <br />A motion was made by Commissioner Getty, seconded by Commissioner <br />Lindsey that Case PUD-85-1 be recommended for approval subject to <br />the conditions shown in the staff report with the following <br />changes: <br />Amend No. 2 to read as follows: <br />That the developer shall remove all English walnut trees <br />along the Mohr Avenue frontage of the subject property and <br />replace them with minimum 24" box trees acceptable to the <br />City staff. <br />Delete No. 5 <br />Amend No. 9 to read as follows: <br />That the development shall be subject to the siting standards <br />shown on page 3 of the development plan. Except as otherwise <br />established by the conditions of approval of case PUD-85-1, <br />the uses and site standards for the detached single-family <br />residential portion of the project shall be those of the <br />R-1-7500 District and the uses and site standards of the <br />paired single-family residential portion shall be those of <br />the RM-4000 District. <br />Amend No. 11 to read as follows: <br />That a homeowners association comprised of owners of the <br />paired single-family residences shall be established for <br />maintenance of all commonly owned areas and that the CC&Rs <br />of the development shall be submitted to the City for <br />approval prior to submittal of a final map. That the City <br />shall be named as third party beneficiary of the CC&Rs and <br />granted the power to enforce their provisions if the <br />homeowners association fails to do so. <br />- 6 - <br />
