Minutes <br />Planning Commission <br />2/27/85 <br />building and will have to look elsewhere for their childcare <br />facility. <br />Chairman Doherty asked staff about the building inspection. Mr. <br />Cox said they want to do what the City wanted but now it appears <br />that they have even lost their $150 application fee. He said he <br />had met with Mr. Gee in the past and Mr. Gee foresaw no problems <br />with the use. <br />Commissioner Innes asked at what point Mr. Cox was informed that <br />the building was not up to Code. Mr. Cox replied the first he <br />knew about it was when he received a copy of the staff report. <br />He said they didn't get a copy of the staff report until they <br />came to the meeting two weeks ago. Mr. Cox said they would have <br />handled any problems. They spent hours preparing documents for <br />the State. They have to have a conditional use permit before <br />they can get State approval. <br />Chairman Doherty asked whether or not a permit was requested and <br />issued. Mr. Gee indicated that a second story office and stair <br />case were added after the original permit was completed. Mr. Cox <br />said he had talked to Gary Smith who had no problems with it. <br />Mr. Gee indicated that Mr. Smith basically looked at the site <br />from a safety standpoint. He had problems with the spans and <br />structure. Staff was concerned about how well supported the <br />second story addition was so staff checked it. The result was <br />there would be no problem in getting a permit but a minor amount <br />of work would have to be done to bring the structure up to code. <br />Commissioner Wilson suggested perhaps the $150 should be <br />refunded. Mr. Harris stated that very often times the staff does <br />not know what conditions will be added until the report goes out. <br />After further discussion the Planning Commission stated that the <br />$150 application fee would be transferred to another application <br />upon receipt of such application. <br />REVISIONS AND OMISSIONS TO THE AGENDA <br />Mr. Harris stated that Item 5b was with drawn, that Cases <br />PUD-82-18-6D and PUD-85-1 should be continued to 3/13/85. <br />MATTERS INITIATED BY COMMISSION MEMBERS <br />Commissioner Getty reported that many people are making "U" turns <br />on Hopyard Road for the daycare facility located on Hopyard and <br />Del Valle Parkway. This is creating a traffic hazard. <br />Commissioner Innes said there is a very dangerous situation at <br />Foothill KNolls at Foothill Road regarding the left-turn <br />southbound lane. Mr. Warnick stated he will look into the matter <br />but this is in the county and is currently being worked on. <br />Chairman Doherty reported that several of the Commissioners will <br />be attending the League of California Cities Planning <br />Commissioners Institute the end of this month.
