Minutes <br />Planning Commissio. <br />2/13/85 <br />be called in to look at the plans, paving and effects all of this <br />will have on the existing trees. Regarding the building permits <br />for the structure put up without benefit of building permits, if <br />the daycare facility is allowed to open without this being <br />remedied, the owner will probably not have an incentive to take <br />care of this matter at a later date. <br />Commissioner Getty fully supported this use permit. Daycare <br />centers are needed in the neighborhoods. She had concerns with <br />the existing property not being up to Code. She felt these <br />concerns should be taken care of by the property owner. The <br />plans presented by the applicant are not complete nor are they to <br />scale. The applicant should be made aware of fencing, paving, <br />etc. <br />Commissioner Wilson indicated that he does not support the tree <br />ordinance. The City as an ordinance by which they do not abide. <br />30 trees were cut down on Valley Avenue. Bernal Avenue have <br />trees marked in red for removal. He said Tiburon has an <br />ordinance requiring all trees be cut down. He feels the <br />ordinance is totally ridiculous. Tree experts frequently <br />indicate a tree is good and it dies while an apparently unhealthy <br />tree thrives. <br />Commissioner Innes expressed concern with the possibility that <br />the applicant does not fully understand what they may be getting <br />into with regard to costs. He would like to see the signs <br />removed from the fences, the house painted one color and have the <br />property cleaned up in an acceptable manner. <br />Commissioner Getty also felt that perhaps the applicants are in <br />over their head and perhaps do not understand the ramifications <br />of the conditions. She asked the applicant if they need a <br />location before they can get a State license. Ms. Cox said they <br />do. Commissioner Getty would like to see the matter continued to <br />the next meeting so that the applicants can explore the full <br />meaning of the conditions which would be imposed on the property. <br />Chairman Doherty advised the applicants to consult with their <br />potential landlord regarding the paving, trees, building permits <br />for the illegal structures, etc. <br />The public hearing was closed. <br />Commissioner Getty made a motion to continue Case UP-85-2 to <br />2/27/85. Mr. Harris reported that the applicants have signed the <br />lease. He asked that the Commission articulate the conditions <br />they would impose. He further stated that the property is not <br />illkept. If it was, the staff would have recommended that it be <br />cleaned up prior to approval of the conditional use permit. <br />Commissioner Getty indicated that the applicant should explore <br />the tree subject with a tree expert, building permits for the <br />illegal structure, heights of existing fences, paving required or <br />a variance granted for the lack of paving. <br />- 5 - <br />
