Minutes <br />Planning Commissio: <br />2/13/85 <br />needed to keep the children contained. The redwood trees are <br />right by his driveway and he felt this would create a dangerous <br />situation in not being able to see the children. He had problems <br />with the scale of the site plan, existing and proposed. In the <br />proposed site plan trees appear that don't appear on the existing <br />plan presented. There are two trees on the lot line by their <br />garage. He prefers they remove the tree rather than cut the <br />branches off. He is afraid the root system will do damage to the <br />old garage house which is close to the lot line. <br />Commissioner Lindsey asked about cleaning up the site as <br />discussed by Mr. Cordtz earlier. Mr. Cordtz indicated that there <br />are scattered signs all over the yard. He expressed a great deal <br />of concern about the trees and the fact that he has posted a <br />$25,000 bond to see that nothing happens to them. <br />Chairman Doherty asked staff whether or not the current applicant <br />should also post a $5000 bond per tree. Mr. Warnick stated that <br />it could be required, however, they are not changing the grading <br />significantly. He didn't feel, at this point, that a tree report <br />is necessary. If the Planning Commission feels it is needed, it <br />can be required. Chairman Doherty indicated that if the City <br />requires paving, this could conceivably impact trees and, <br />therefore, it would be prudent to get a tree report. <br />Commissioner Wilson indicated he felt the City should definitely <br />be responsible for any liability for injury or property damage if <br />a tree falls down or branches fall off. He indicated he has a <br />tree on his property at Foothill/Bernal leaning 30 degrees. When <br />the house was there, one didn't notice that the tree was leaning. <br />Mr. Harris suggested that the traffic on the subject property <br />would probably not damage the trees for which Mr. Cordtz has <br />posted a bond. Mr. Cordtz indicated that he wants this liability <br />shared. Mr. Cordtz further had problems with the possibility <br />that roots of the trees would destroy the foundation of his <br />garage house. <br />Commissioner Getty asked about these trees. Mr. Harris indicated <br />they are fairly small. <br />Commissioner Getty asked if this Diablo Termite was a home <br />occupation or commercial use. Mr. Swift indicated that when they <br />moved in it was probably commercial. Mr. Cordtz indicated this <br />is not the case. They all bought their properties at the same <br />time from the Regalias and the properties were zoned residential. <br />Lisa Cox indicated that the front fence is 2-1/2 feet and they <br />were planning to paint and lattice it to increase the height to <br />four feet. Chairman Doherty asked if this appeared on their <br />plans and suggested that the applicant review the City's <br />requirements with the City staff. <br />The public hearing was closed. <br />Commissioner Lindsey stated that Mr. Cordtz was required to post <br />a bond for the trees and that it is reasonable that a tree expert <br />- 4 - <br /> <br />
