Minutes <br />Planning Commissio: <br />2/13/85 <br />Ms. Cox indicated that all of the conditions in the staff report <br />are fine except they would prefer not to have to pave the <br />driveway. They would like to install pea gravel. Mr. Warnick <br />explained that the Zoning Codes requires paving be done. <br />Commissioner Lindsey inquired about Ms. Cox's State license. She <br />explained that it is their intent to turn the application in <br />tomorrow if they are approved tonight. He then asked of taking <br />care of children six weeks of age is unusual. Ms. Cox said that <br />it is in this area. <br />Commissioner Getty asked about the bed and breakfast use recently <br />approved and where it is located with relationship to this <br />proposed use. Mr. Harris indicated that it is immediately next <br />door. <br />Commissioner Wilson stated he had no problem with the childcare <br />facility opening before the roof is fixed. Mr. Harris indicated <br />that there is also an illegal second-story loft. The property <br />owner had permission for a carport and they constructed a <br />two-story building and it is anybody's guess as to the condition <br />of that illegal structure. <br />Commissioner Innes asked Ms. Cox if her lease depends upon City <br />approval. Ms. Cox indicated that she had asked the landlord if <br />the permit didn't go through that he return the deposit. The <br />property owner indicated to her that he would refund it. <br />Chairman Doherty asked the applicant if when she made <br />arrangements to lease and open up an infant care facility she was <br />aware that there would be a bed and breakfast establishment next <br />door. She indicated she had no previous knowledge of that and <br />found out last week. Commissioner Wilson asked Ms. Cox how long <br />ago she began plans for this. Ms. Cox indicated that two months <br />ago they began discussion of the proposal. <br />The Commission then discussed the cost of the conditions which <br />would be imposed and wondered if the applicant was prepared to <br />incur them. <br />Commissioner Getty asked about the previous use of this house. <br />Ms. Cox indicated that it is owned by Mark Schirato and was used <br />by Diablo Termite as an office. <br />Robert Cordtz, 262, 248, 269 West Angela Street, indicated his <br />property is adjacent to the subject property. He did not object <br />to the use proposed but had problems with the unsightly <br />appearance, the two-story building which is not enclosed, <br />heritage trees on the lot line and increased traffic. He <br />indicated he had to post $25,000 bonds for the trees on the lot <br />line guaranteeing that they would live one year. He would like <br />to see the applicant go to a tree specialist like he had to do <br />and get a survey stating that increased traffic running over the <br />road will not do any damage to the trees. He is a little <br />concerned about the low fence (2-1/2') in the front of the house <br />where children will be playing. He felt close supervision is <br />- 3 - <br />
