Minutes
Planning Commissio.
2/13/85
Chairman Doherty then discussed the continuance with the
Commissioners. It was the consensus that everyone be allowed to
speak at one time concerning this matter and therefore that Case
PUD-84-22 be continued to 2/27/85 at the applicant's request.
MATTERS INITIATED BY COMMISSION MEMBERS
Chairman Doherty announced that the Planning Commissioners
Institute will be held February 28 - March 2 at Marriotts in
Santa Clara. While Commissioners have signed up, he felt it
would be appropriate that a member of the Planning Staff also
attend. Mr. Harris indicated that he was not planning on having
a staff member attend but if the Commission felt that it was
important that this could be arranged.
OLD BUSINESS - Public Hearings
PUD-84-22, Harbor View Investment, Inc.
Application of Harbor View Investment, Inc. for Planned unit
Development zoning and development plan approval to construct an
approximately 156,000 sq. ft., 212 unit hotel and related
facilities on an approximately 3.6 acre site located on the east
side of Dublin Canyon Road (11910 Dublin Canyon Road),
approximately 0.2 mile north of Foothill Road. Zoning for the
property is "A" (Agricultural) District. A negative declaration
of environmental impacts will also be considered.
This item was continued to 2/27/85 at the request of the
applicant.
NEW BUSINESS - Public Hearings
UP-85-2, Lisa Cox and Debra Reynoso
Application of Lisa Cox and Debra Reynoso for a conditional use
permit approval to operate a day care facility for up to 25
children at 278 West Angela Street. Zoning for the property is
RM-1500 (Multi-Family Residential) District.
Mr. Harris presented the staff report.
The public hearing was opened.
Lisa Cox, San Antonio Street, addressed the Commission stating
she will be taking care of children six weeks of age to 2 years
of age, not six months of age as stated in the staff report. She
indicated that she is intending to contact the owner of the
property tomorrow concerning the loft. She asked if she would
have to wait for the owner to get building permits for the
carport and remedy his violations before she opened for business.
Mr. Harris indicated that it would probably increase the owners
desire to legitimize these defaults if this condition is imposed
upon approval of her proposed use.
Mr. Swift indicated that the City would not be liable in any way
concerning the structure since it was put up without a permit.
- 2 -
