Minutes <br />Planning Commission <br />September 24, 1986 <br />addition condition is added to reflect the approval of the sales <br />aspect of the trailer use to expire in 18 months from the date of <br />approval. <br />ROLL CALL VOTE <br />AYES: Commissioners Hoyt, Innes, Michelotti, Wellman <br />and Chairman Lindsey <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />Resolution No. 2840 was entered and adopted approving Case <br />UP-86-35 as motioned. <br />PUD-80-2-2M, Koll Bernal Avenue Associates, et al <br />Application of Roll Bernal Avenue Associates and Patrician <br />Associates, Inc. for development agreement approval for a <br />business park complex to be located on an approximately 99 acre <br />site, located generally in the area bounded by Bernal Avenue, <br />Interstate 580, the Arroyo del Valle, and Valley Avenue. Zoning <br />for the property is PUD (Planned Unit <br />Development)-Industrial/Commercial District. <br />Mr. Lew presented the staff report recommending approval of the <br />proposed development agreement. <br />The public hearing was opened. <br />Harvey Levine, attorney for the proponents, 4637 Chabot Drive, <br />stated that this agreement follows the format of Prudential, with <br />two significant differences; Prudential's goes to the year 2000 <br />and this one goes for 12 years. Further they propose to have a <br />condition including the letter dated September 23, 1986 as an <br />exhibit, relating to the landscape areas of the arroyo that have <br />been improved in order to avoid erosion. Section 6 of the <br />agreement shall also be amended to provide a time frame. <br />Commissioner Innes discussed page 6 of the staff report and asked <br />Mr. Levine if they were willing to participate in mitigation <br />measures as they may come up in the future. Mr. Levine said they <br />are willing to participate in mitigation measures as applicable <br />to soften concerns as it relates to their project. <br />The public hearing was closed. <br />A motion was made by Commissioner Wellman, seconded by <br />Commissioner Hoyt to recommend approval of PUD-80-2-2M, the <br />development agreement for Koll Bernal Avenue Associates subject <br />of the conditions of the staff report, adding a condition <br />relating to the revegetation and landscaping of the arroyo, <br />including the letter of September 23, 1986 as an exhibit to the <br />agreement. <br />- 7 - <br />
