Minutes <br />Planning Commission <br />September 24, 1986 <br />That was his main concern because if the foliage remained, he <br />couldn't even see the business park, thus, it would have no <br />effect on him. Commissioner Innes asked if there was any <br />discussion during the approval stage by Zone 7 to make the arroyo <br />conform to Zane 7's Code. Mr. Mrzywka indicated the homeowners <br />had no knowledge about Zone 7's requirements. Commissioner <br />Michelotti then asked if the City was aware of the plan for <br />removal of the trees and foliage required by Zone 7, and asked if <br />there is a landscape plan saying which ones would be removed and <br />which ones would stay. <br />Mr. Swift then reviewed the bank failures due to flooding. <br />Originally there was not to have been any removal of trees. The <br />only trees scheduled for removal were the downed trees. Because <br />of bank failure, there was a major modification to the plans <br />showing a revised treatment along the arroyo. Basically the plan <br />was to retain the vegetation with the exception of adding a path <br />in the creekbed. The location of the two access points into the <br />creekbed were designed to minimize destruction of the south side <br />of the bank. After the PUD approval, Koll tried to get approval <br />from Zone 7. Zone 7 indicated that channel improvements done in <br />areas of existing bank failure were necessary. In addition <br />other areas would need to be repaired as well.The requirements <br />were incorporated into the new plans shown to staff by the Koll <br />Company. The plans were not forwarded to the Planning Commission <br />for review. Fish and Game asked that any work within the channel <br />be done by October 1, 1986 (October 15 is the normal deadline). <br />Full landscaping of the entire area is to be done with the first <br />phase of the development. Tree removal is required and the <br />developer is proposing to replant with large trees. Koll has <br />presented plans for staff approval, in accordance with conditions <br />of the PUD approval. The final landscape plan has not been done <br />at this time. Replanting does include replanting the creekbed <br />and the top of the bank. Maintenance of those areas from the top <br />of the bank back will be the responsibility of Koll. The creek <br />itself will be maintained by Zone 7. <br />Commissioner Lindsey asked if the Koll company hadn't developed <br />the site any improvements would have been done requiring tree <br />removal. Mr. Swift discussed the 100 year flood and the lake <br />effect from the Arroyo de la Laguna. There have been several <br />bank failures. Whether or not the improvements would have to be <br />done through coming in the south side and make improvements is <br />conjecture. <br />Mr. Mryzwka indicated there is an upstream restriction on the <br />south side of one of the bridges that causes flooding in the <br />area. He asked Zone 7 to look into this. <br />Vince Wong, Zone 7, discussed this matter. When improvements are <br />made generally they are done by the developer with reimbursement <br />through Zone 7. There was a bank slide further down the stream <br />and no action was taken. Areas subject to erosion were revealed <br />by soils studies by a consultant retained by Koll. Homeowners <br />should understand that when Zone 7 gets involved in repairing <br />eroded areas, they only plant vegetation to prevent further <br />- 3 - <br />_. _. r <br />
