Minutes <br />Planning Commission <br />August 13, 1986 <br />to have video games and maintain hours of 7:OOam to ll:0opm. <br />Mr. Robinson has spent time talking to neighborts in the area. <br />He has come to the conclusion that some are not sure how they <br />feel about it, others just plain do not want it. <br />Dave Baxley, 3911 Fairlands, President of the Homeowners <br />Association, understand the problems but other areas do not have <br />a County jail and the hours are not restricted for releasing <br />prisoners. Convenience markets also sell alcohol and tobacco. <br />He stated that when their association was polled, the people <br />voted not to have a convenience store-type of use. Convenience <br />food markets have been trying to get into the area for a long <br />time. Two or three applicants have been turned down because of <br />neighbors' concerns. The citizens of the area negotiated with <br />the applicant in good faith at the time the shopping center was <br />presented for approval. They could accept a market selling meat <br />or produce, but not a convenience market. <br />Commissioner Michelotti asked Mr. Baxley to specifically address <br />the neighborhood's concerns with regard to convenience stores. <br />Mr. Baxley responded that the vast majority of residents in the <br />area are opposed to this type of use. There are 830+ homes in <br />the area surrounding Fairlands. 60-70% do not want this type of <br />development. They desire to havleatoethebocommunityoppomgthenter. <br />It is not desirable to draw peop <br />freeway. <br />Rebuttal <br />Mr. Robinson stated that development of the area wouldrisonersthe <br />potential for trucks parking in the area. Regarding p <br />Mr. Robinson said he has seen prisoners running through his own <br />backyard. The County is taking steps to prevent this from <br />happening. By the time the shopping center would be opened, this <br />problem would be reduced. Mr. Robinson stated that some <br />convenience markets do not sell hard liquor but rather only sell <br />beer, wine and cigarettes as well as food. <br />Commissioner Wellman stated that a lot of work and negotiating <br />went into the elimination of convenience stores from the list of <br />uses allowed in this development. Commissioner Hoyt agreed with <br />this comment. <br />Vice Chairman Innes said there have been at least four public <br />hearings on this subject with concerns expressed regarding <br />traffic, the freeway interchange, etc. Vice Chairman Innes could <br />not support this application. <br />Commissioner Michelotti had sympathy with the applicant incenter. <br />they need a draw to get others to develop in the shopping <br />- 3 - <br />._ 1 <br />
