EXHIBIT "A" <br />CONDITIONS OF APPROVAL <br /> Z-90-469 <br /> 8/21/90 <br /> <br />The regrading of Lot 2 of Tract 5835 shall conform <br />substantially to the revised grading plan, dated "Received <br />August 16, 1990", on file with the Planning Department. <br /> <br />The retaining wall installed as part of the regrading of the <br />subject lot shall meet the requirements of the Building Code, <br />with permits secured for all those requiring them. <br /> <br />The applicant shall submit to the Planning Department a plan <br />illustrating any proposed above-ground structure (i.e. <br />trellis, deck, gazebo, shed, etc.) and their location, prior <br />to construction. The Planning Department shall notify <br />adjacent property owners of the proposed structure prior to <br />any action on the submittal. In the event an adjacent <br />property owner asks for a formal hearing concerning the <br />requested structure, a hearing shall be scheduled at the next <br />available City Council meeting for City Council review and <br />approval. In the event no hearing is requested within 7 days <br />following sending of notice, the Zoning Administrator may <br />approve, approve conditionally, or deny the requested <br />application following the guidelines established in Section <br />18.20 of the Municipal Code for Design Review Board approval <br />of new applications. <br /> <br />The applicant shall submit a plan illustrating the proposed <br />planting of evergreen shrubs and/or trees in the rear 25 feet <br />of Lot 2 in order to screen the views of the rear yard of <br />3118 Catawba Court from the project site. This plan shall be <br />submitted for review and approval by the Planning Director <br />prior to any regrading on the lot. The applicant shall <br />install the landscaping contemporaneously with the <br />construction of the retaining walls and maintain it in <br />perpetuity. In the event that any of the plant material <br />dies, the applicant shall remove it and shall replant with <br />identical plant material within 30 days of the death of the <br />plant material. <br /> <br />The applicant shall properly maintain the concrete "V" ditch <br />adjacent to the rear property line at all times, making it <br />continuously available to pass storm drainage at the full <br />capacity to which it was designed. <br /> <br />0 <br /> <br />No permit for retaining walls shall be issued for the <br />proposed regrading until the proposed landscape planting plan <br />for the adjacent lots in the older Vintage Hills subdivision <br />is approved by the City. <br /> <br />SR:90:352 <br /> <br />-1- <br /> <br /> <br />
