e <br /> <br />The applicant shall design the westerly retaining wall height <br />in such a manner that it shall be at least 6 feet below (in <br />elevation) the top of the property line fence at all points <br />perpendicular to the retaining wall. The property line fence <br />shall be reconstructed as necessary to be solid 6 feet in <br />height above the elevation of its adjacent retaining wall <br />segment. If the lattice section is replaced to achieve the <br />solid fence requirements, matching lattice shall be applied <br />to the top 2 feet of the solid fence on both sides of the <br />fence to achieve a consistent fence design. In the event the <br />fence would exceed 8 feet above grade, a variance shall be <br />sought for the taller fence. <br /> <br />No permits shall be issued and no regrading shall commence <br />until the City has reached an agreement with Amador Valley <br />Savings and Loan and other interested parties, as to the <br />responsibility for the cost of the proposed landscape <br />planting plan, the installation of additional sprinklers, and <br />the height extension of the Stillians' fence. <br /> <br />The applicant shall enter an Agreement, in a form approved by <br />the City Attorney, which Agreement reflects these conditions <br />of approval and which Agreement shall be recorded <br /> <br />SR:90:352 <br /> <br />-2- <br /> <br /> <br />
