if he had complained to Mr. Aaker about the pigeons. Mr. Hoyt <br />indicated he had not because once he complained to the City about <br />someone and suffered harassment from the particular neighbor. <br />Mr. Chafen, partner of Mr. Young, indicated it is his <br />understanding the pigeons were for a high school age person who <br />is now 21-22 year old person who no longer lives at the house. <br />The public hearing was closed. <br />Chairman Wilson stated that in reading the letter of the <br />applicant, he doesn't know why the Commission should approve <br />this. <br />Commissioner Innes indicated that animals properly kept would not <br />affect neighbors, however, one could not keep pigeons from flying <br />and he had concern with that. <br />Commissioner Lindsey stated he had a neighbor with four or five <br />pigeons and he disliked it very much. <br />Mr. Swift reported that true homing pigeons do not roost in <br />places other than their own pens. The staff treated this <br />application as one for homing pigeons. <br />A motion was made by Commissioner Lindsey that findings cannot be <br />made to grant approval of this use permit because the existing <br />location is not appropriate as it effects the health and welfare <br />of the neighbors. Further, it is apparent the applicant has no <br />desire to discuss the matter with the Planning Commission. This <br />motion was seconded by Commissioner Innes. <br />ROLL CALL VOTE <br />AYES: Commissioners Innes, <br /> and Chairman Wilson <br />NOES: None <br />ABSENT: Commissioner Hoyt <br />ABSTAIN: None <br />Lindsey, Michelotti, Wellman <br />Resolution No. 2741 was entered and adopted denying Case <br />UP-85-51. <br />It was indicated by the Chairman that this decision is subject to <br />a 15 day appeal period. <br />PUD-85-12-1M, Brinton <br />Application of William Brinton for a major modification to an <br />approved development plan for a 56-unit townhouse complex, <br />involving changes to elevations and floor plans, on an <br />approximately 6.68 acre site bounded by 3toneridge Drive to the <br />north, Highway I-680 to the east and Stonedale Drive to the west. <br />Zoninq for the property is PUD (Planned Unit Development)-High <br />Density Residential District. <br />This application was withdrawn. <br />- 5 - <br />
