Minutes <br />Planning Commission <br />June 24, 1987 <br />Commissioner Michelotti referred to the traffic report submitted <br />for this proposal. On Table #4, it indicates 0.87 and on page 9, <br />pm peak show a ratio of 0.91 which is LOS "E". She asked if this <br />was a typographical error or if the ratio would be reduced with <br />mitigations in place. <br />Chris Owens, TJKM, stated the 0.87 includes mitigations being in <br />place. Even with mitigations in place, the volume to capacity <br />ratio changed with the annual traffic counts conducted in <br />November 1986. <br />Tom Murphy, Burger King, 1900 McCarthy, Milpitas, regional <br />representative of Burger King, stated while they have no <br />objections to the proposal, they have a concern with the square <br />footage proposed for a corner lot. There will be a total of <br />11,000 sq. ft. of additional occupancy. Although uses will be <br />limited, there are parking and traffic concerns. Approval would <br />double occupancy and basically double the size of the usage on <br />that corner. He invited the Commission to go to the site between <br />11:OOam and 2:OOpm. There is no parking available during that <br />time. Mr. Murphy stated that more parking should be furnished. <br />Mr. Murphy stated that three parking spaces will be lost for 7700 <br />sq. ft., therefore, only eight spaces will be provided. <br />Mr. Murphy presented photographs taken by one of the tenants <br />which depicts the parking problems. The proposed site is <br />currently used for parking. There was a barrier up and it was <br />taken down by a 4x4type vehicle because it couldn't get a parking <br />space. As Hacienda Business Park fills up and there is, <br />hopefully, a larger demand on the shopping center, more parking <br />spaces will be needed for that expansion of use. <br />Mr. Murphy spoke to all of the tenants of the shopping center <br />this morning and they did not know of this proposal until that <br />time. Mr. Murphy presented two letters of tenants of the <br />shopping center expressing concern with the insufficient number <br />of parking spaces. <br />Chairman Lindsey asked if Burger King was notified. Mr. Murphy <br />said they were, but the notice was delayed within their office. <br />Mr. Quaglia explained that legal notice was given to the property <br />owners and not the tenants. Mr. Murphy stated that their lease <br />provides that the permission of Burger King must be given prior <br />to changing the ingress/egress of their restaurant. They would <br />like time to work with the developer and explore the proposals <br />with them. Mr. Murphy asked that the matter be continued. <br />Commissioner Mahern asked how many employees Burger King has at <br />one time on site. Mr. Murphy stated they have between 16-18 plus <br />two managers per shift. Commissioner Mahern asked if the <br />employees were required to park elsewhere. Mr. Murphy said they <br />are but it is difficult to police. <br />Ken Clark, 4026 Suffolk Drive, owner of the yogurt shop, <br />expressed concerns with parking and traffic. Circulation is a <br />problem and there have been automobiles dented behind the yogurt <br />shop because of the configuration of Owens/Hopyard.
