On the previous plan, he would have <br />to look at a lot of driveway. <br />Rebuttal was then given by the Black's architect, Mr. Frechette. <br />He stated that the Black's were actually the victims. They <br />agreed at City Council meeting to a contour plan that they didn't <br />understand. Mr. Frechette was commissioned to plan the best <br />possible usage of the land and contours of the land. When the <br />hillside is done and revegetated, there will be a cabana club and <br />pool with a revegetated hillside which will look great. <br />Mr. Frechette further reported that the Blacks will have title to <br />the property in tYie next day or so when escrow closes. <br />The public hearing was closed. <br />Commissioner Tarver stated that the surrounding residents have <br />done a lot to compromise and it appears the Black's are trying to <br />get to much on a hill, i.e., cabana, pool, and large house. City <br />Council let them move the pad and everyone seemed to agree on its <br />location. Because of these circumstances, he would favor denial <br />of the proposed application. <br />Commissioner Michelotti stated she has gone on the site and <br />looked at the contours of the hills. The original siting was not <br />a good choice. She liked the new proposed roadway and would like <br />staff and the applicant to work out a solution so it would remain <br />the same. Commissioner Michelotti wanted to make sure that the <br />tree is preserved. Commissioner Michelotti would really like the <br />neighbors and applicant to reach a compromise. <br />Commissioner Mahern stated she could see both sides of the <br />situation and acknowledged that a lot of compromises have already <br />been made. <br />Chairman Lindsey recapped that the original pads were approved. <br />This particular applicant came back and asked for a change. The <br />Planning Commission denied it and it went to City Council. At <br />that time a compromise plan was approved. The buyers of this lot <br />should have been aware of what was approved for it. <br />A motion was made by Commissioner Mahern, seconded by <br />Commissioner Tarver that Case PUD-82-10-6M be denied for the <br />reasons stated in the testimony. <br />ROLL CALL VOTE <br />AYES: Commissioners Mahern, Tarver, and Chairman Lindsey <br />NOES: Commissioner Michelotti <br />ABSENT: Commissioners Berger and Hoyt <br />ABSTAIN: None <br />Resolution No. PC-87-69 was entered and adopted denying Case <br />PUD-82-10-6M as motioned. <br />Chairman Lindsey that the applicant has 15 days in which to <br />appeal the denial decision to the City Council. <br />- 10 - <br />_~...T_. <br />
