Minutes Planning Commission June 24, 1987 Jim Balch, 14 Grey eagle Court, Lot 20, across from the subject property, stated he has read and agrees with the staff recommendation. Mr. Balch stated that it is intended to add a cabana club and pool and this would be the reason for the change. The pad location proposed is at 604 feet and his house sits at 602, therefore, he is two feet lower. Mr. Balch said the residents had discussion with the Black's after the Planning Commission meeting last year. There was an understanding and workable solution reached with the Black's at that time and the proposal was revised and approved by City Council. Mr. Balch reviewed the discussions between Mr. Plummer and the applicants at that time. Mr. Balch said they would very much like to work with the Black's but it hasn't worked out. Commissioner Michelotti asked if the design of the house is a problem. Mr. Balch said he has no problem with the design of the house. Chairman Lindsey then asked Mr. Balch if he would entertain another compromise. Mr. Balch said he would not compromise further. Commissioner Michelotti asked if the original topographical map had been correct would the outcome have been different. Mr. Quaglia stated the significant change is the excavation of the rear yard. Further to his knowledge the applicant has never talked to the Fire Department concerning the required on-site emergency vehicle turn around area. Commissioner Mahern asked if there could be a motion to save the tree. Commissioner Tarver stated there is a previous condition on the project to save the free as well as to provide a Fire department turnaround. Mr. Balch pointed out that another pad would be necessary to add a cabana club. Commissioner Michelotti then asked Mr. Balch if he was opposed to a cabana club. Mr. Balch said he is opposed to any building pad being moved. Michael O'Callaghan, 8 Grey Eagle Court, commended the staff on their report. Mr. O'Callaghan did not have a problem with the design of the house. His concerns related to open space, views, panorama looking at the hills from through windows in homes which are already constructed. Mr. O'Callaghan stated that the pad proposed is a buildable one, but not a desirable one. The alternative to a house pad was a water reservoir and the neighbors opted for a home site. Mr. O'Callaghan reported that only after her application was denied by the planning Commission did she attempt to negotiate with the neighbors. Further if no homes were built in the area, there would not be a problem with the location of the house as proposed, but all of the homes have been designed and/or built with windows, etc. facing out on the the proposed building pad and it is just not fair to the existing homeowners to change everything now. Mr. O'Callaghan then presented a letter from the Mendoncas, other homeowners in the area, who urge denial of the proposal.
