Minutes <br />Planning Commission <br />Wednesday, April 22, 1987 <br />PUD-$3-10-3M/83-12-2M, bas Homes <br />Application of bas Homes for a major modification to an approved <br />development. plan for a 29-unit residential project to permit <br />private streets serving the development to be changed to public <br />streets to be located on an approximately 25 acre site, located <br />generally in the area bounded by Mohr Avenue, Martin Avenue, and <br />Cameron Avenue. Zoning for the property is PUD (Planned Unit <br />Development) - Low Density Residential District. <br />Mr. Swift presented the staff report. <br />Chairman Lindsey asked if there are existing public streets <br />similar to the width proposed within the City. Mr. Swift stated <br />that Division Street, between Peters Avenue and the railroad <br />tracts is of similar width. There are probably others in the old <br />part of town. Chairman Lindsey then asked if there are any new <br />developments in town with similar street widths? Mr. Swift <br />reported that there is a new street in Foxbrough with the same <br />configuration but other new streets of this width are private. <br />Chairman Lindsey reported that in the past he has stepped down in <br />considering items in the Mohr-Martin Area because he was <br />considering purchasing property in the area. This is no longer <br />true, and he will be considering applications in the area. <br />Commissioner Hoyt asked about the street widths in Kottinger <br />Ranch. Mr. Swift again reported that they are all full size <br />except for private sections with the exception of one cul-de-sac <br />with houses only on one side. <br />The public hearing was opened. <br />Steve Stern, bas Homes, Inc., urged approval of their <br />application. Mr. Stern reported that in his mind the difference <br />between a public and private street relates to control. <br />Rich Alexander, bas Homes, Inc. also urged approval of their <br />application. Mr. Alexander stated that the street system looks <br />and acts like a public street. The problems relate to control. <br />Their company would have no control of the 28' wide streets and <br />therefore, they should not be private streets. Anyone can use <br />them. They have had meetings relating to gating off the streets. <br />The Fire Department does not go along with this concept. Cameron <br />is a public street connecting to another section of Cameron which <br />is private. Generally, private streets do not make abrupt left <br />or right turns. Cameron comes from a private street directly <br />onto a public street. There is no ability to control what <br />happens on this segment of the private street. Bas Homes was <br />forced to build homes facing Mohr Avenue. There are homes facing <br />on Cameron. Streets without controls increase maintenance which <br />increases liability. There is an insurance problem. The City <br />has asked bas Homes, Inc. to come up with a mechanism for <br />maintenance. This would mean an association which would have to <br />allow future owners and developers to come in, it would allow <br />pre-existing people to come in the association but after bas <br />Homes, Inc. builds out this portion, they will not have control <br />- 6 - <br />
