Minutes <br />Planning Commission <br />Wednesday, April 22, 1987 <br />PUD-87-5, Stoneson Development Corp. <br />Application of Stoneson Development Corporation to rezone from <br />the RM-2500 (Multi-family Residential) District to the PUD <br />(Planned Unit Development) - High Density Residential District <br />and for development plan approval for a 104-unit townhouse <br />complex, to be located on an approximately 13.5 acre site, <br />located in the area bounded by Stoneridge Drive, Springdale <br />Avenue, Gold Creek, and Pleasant Hill Drive. <br />This matter was continued to May 13, 1987. <br />UP-87-6, Evans/Game Station <br />Application of Larry Evans and the Game Station for a conditional <br />use permit to operate a game arcade, to be located at 4301 Valley <br />Avenue. Zoning for the property is PUD (Planned unit <br />Development) - Commercial District. <br />Mr. Swift presented the staff report recommending approval of <br />this application subject to the conditions listed in the staff <br />report. <br />Chairman Lindsey noted the absence of a representative from the <br />Police Department and asked staff to express his disappointment <br />at such absence. Mr. Swift stated that the staff report includes <br />recommendations of the Police Department. Mr. Swift stated that <br />the matter could be continued to allow a representative of the <br />Police Department to be present. Mr. Evans stated that his lease <br />must be signed in two weeks and asked that his application not be <br />delayed. <br />Commissioner Tarver discussed the signage of the seven entrances <br />and vehicle code enforcement. This employs trespassing laws <br />rather than enforcement of conditions. <br />Staff and the Commissioners then discussed the fact that <br />loitering laws are almost unenforceable. <br />Commissioner Mahern asked about additional lighting. Mr. Swift <br />reported that the Police Department indicates that it is <br />well-lighted, but they want the condition listed as shown to give <br />them the ability to ask for more lighting in the future should it <br />be needed. <br />The public hearing was opened. <br />Larry Evans, 2716 Lariat Lane, Walnut Creek, the owner of the <br />Game Station, urged approval of his application. Mr. Evans then <br />addressed issues posed in the staff reports. Mr. Evans spoke to <br />the security service and stated all participants in financing of <br />it no longer want to financially participate. It hasn't worked. <br />The Jack in the Box doesn't participate in the security service <br />and there is loitering in that area. The Jack in the Box have a <br />much larger use than the Game Station. Mr. Evans stated he has <br />been in contact with the Police Department (Freeman and Todd) as <br />to the responsibility of the Game Station. Mr. Evans reported <br />that these gentlemen informed the Game Station that unless there <br />- 12 - <br />
