Minutes <br />Planning Commission <br />Wednesday, April 22, 1987 <br />is a blatant violation of the law there is not much they can do. <br />Mr. Evans reported that he does not rent the parking lot, only <br />the Game Station and sidewalk in front of it. When there is a <br />problem in the Game Station, his employees act quickly on it. <br />Mr. Evans felt it unfair to ask him to bear the total cost of <br />hiring security people. Mr. Evans said that speeding and that <br />type of violation is the least of their problems. Mr. Cupples <br />(landlord) has indicated to him that when furnished a copy of any <br />ordinance for posting, he would be willing to cooperate with it. <br />Mr. Evans believes problems of the area should be shared with <br />other merchants. <br />Mr. Evans then addressed the condition requiring a one-year <br />review period. He asked for a five year period of review to <br />coincide with his lease which will be negotiated within the next <br />two weeks. Mr. Evans indicated he would welcome an informal <br />review by anyone at any time but asked that no such constraint be <br />affixed to his conditional use permit. Mr. Evans then reviewed <br />each item of the staff report. He wanted Condition No. 2 to be <br />satisfied by allowing the security guard to be the second adult <br />supervisor. He objected to Condition No. 3 totally as he is not <br />renting the parking lot and has no control over the area. <br />Commissioner Mahern asked if the conditional use permit can be <br />revoked. Mr. Swift stated it can be revoked if violations of <br />conditions of the conditional use permit occur. <br />Mr. Evans argued that the problems in Valley Plaza are City's <br />problems because of the proximity to schools, parking layout, <br />etc. The loitering in front of Perry's Liquors is not done by <br />the customers of the Game Station. Mr. Evans reported that he <br />has been associated with this type of business for about eight <br />years, part of that time as a vendor, and 90% of the patrons <br />cause no problems whatsoever. <br />Commissioner Berger stated that she had interviewed local <br />teenagers and asked for their opinions. Pinball machines attract <br />older people and video machines attract young ones. <br />Mr. Evans stated the above comments are indeed true. His <br />business is a family business and dads want pinball machines <br />while children prefer video games. <br />George Pereira, 5591 San Juan Way, spoke in frustration saying <br />they have tried very hard to minimize loitering and problems in <br />the shopping center. Mr. Pereira indicated he is going to cut <br />the hours of his business back by one hour each day for lack of <br />business late at night. The security people cannot go onto Jack <br />in the Box tenant space. Mr. Pereira agreed that loitering and <br />problems associated with the shopping center are a City problem. <br />There has been no upkeep of the shopping center over the years. <br />There are holes in the roof, etc., and the entire shopping center <br />is a hodgepodge. The City has to get together with the landlord <br />and give them direction and make them responsible for their <br />property. Once a person leaves a store and is on the blacktop, <br />there is nothing a merchant can do regarding loitering and <br />- 13 - <br />
