MINUTES <br />PLANNING COMMISSION <br />JANUARY 14, 1987 <br />The trees planted have created a situation where very little lawn <br />remains at the residential units. She requested that deep rooted <br />trees be planted. The existing soundwall does not mitigate noise <br />in her opinion. Tn fact, there are broken down areas, as well as <br />areas with cracks in it. Vice Chairman Innes asked if the City <br />staff has ever been called about the noise problems. Ms. Yssels <br />stated once anything is on a site, you become stuck with it. The <br />Nob Hill Market does their gardening at 12:00 Midnight. Mr. <br />Swift stated that staff did receive a complaint concerning the <br />dumpsters, Nob Hill was contacted, and asked to abide by their <br />conditions of approval. Mr. Swift indicated that if the <br />situation still persists the City can write a letter to the <br />garbage people and ask that the time of service be changed. <br />Vice Chairman Innes was sympathetic with the residents on the <br />issue of noise especially when there are conditions imposed upon <br />project approval to safeguard such concerns. Mr. Swift stated <br />that staff needs to be notified when violations of this type <br />occur. <br />Clyde Weese, 3148 Weymouth Court, called the Police when the <br />blower was going at 4:OOam. The sergeant informed him that it <br />would have to be researched. Trucks come in at 5:OOam and idle <br />for long periods of time. Nob Hill doesn't open until 6:OOam. <br />Trucks are refrigerated and must idle for their equipment to <br />work. The Police Department does not respond to calls. Mt. <br />Mike's had a fight at 12:00 O'Clock one night. There were five <br />people beating up on one person. The Police were called and <br />responded by asking Mr. Weese what the people were wearing. <br />John Ferreri, managing partner of the shopping center, <br />apologized for the problems. The blower company was changed and <br />they do not start until after 7:OOam anymore. Regarding trucks <br />parking in back of the store, Mr. Ferreri, met with the manager <br />of Nob Hill. The management indicated they would be happy to do <br />whatever is necessary to eliminate the problem. <br />Regarding the project itself, Mr. Ferreri said he has had several <br />meetings with the project applicants and they have been very <br />cooperative. They agree that backing up the two buildings is <br />probably optimum but it is unworkable. There is a similar <br />situation with Mission Plaza and the two building project. Mr. <br />Ferreri further stated that with spring-loaded gates security <br />would be provided. Mr. Ferreri urged the Weymouth Court people <br />to contact him regarding the noise of blowers and garbage pick up <br />should the problem continue. <br />Commissioner Michelotti, Messrs. Swift and Ferreri discussed the <br />effects of the soundwall between the market and the residences to <br />the east. Mr. Swift explained that the real purpose of the wall <br />was not a 'soundwall' per se, but to to minimize the noise, etc. <br />from the loading dock. At 4:OOam there is very little which <br />could be done to minimize noise. <br />Vice Chairman Innes asked Mr. Horsley how much truck traffic will <br />be generated by the new major tenant.
