Commissioner Mahern said <br />for 30 days for more input from the downtown merchants. <br />Chairman P7ichelotti said the case would be continued to the <br />first meeting in November and directed staff to notify the <br />Chamber of Commerce and the Downtown Association. <br />Tract ~9451_Currin/Timor <br />Application of Currfn Construction and Timm Development, Inc. to <br />subdivide an approximately 260 acre site into 80 parcels for <br />single-family residential use and 4 parcels for common open <br />space and related uses, ranging in size from approximately <br />39,000 sq. ft. to approximately 7 acres, located on the west <br />side of Foothill Road approximately 3,100 sq. ft. south of the <br />intersection of Bernal Avenue and Foothill Road. Zoning for the <br />property is PUD (Planned Unit Development) - Low Density <br />Residential/Open Space District. <br />Mr. Swift presented the staff report recommending approval of <br />Tract 5945 subject to conditions of the staff report. <br />The public hearing was opened. <br />Ted Fairfield, Consulting Engineer, 5510 Sunol Blvd., <br />represented the application. He concurred with the amended <br />Conditions of No. ib, 3(7 and 35, understanding they will be <br />deleted. <br />Joe Elliott explained that No. 16 is not required as there will <br />be rolled curbs and gutters. <br />Commissioner Havingh asked if that holds true for cul de sacs. <br />Mr. Elliott said no. <br />Mr. Elliott said Condition 3G does not apply to the project. <br />Condition 35 does not show on the tentative map and it is <br />preferred not to try to tie the developer and engineers dawn by <br />required the developer to come to him every time there is a <br />minor change. He recommended that it also be deleted. He also <br />recommended that Condition 5(7 be amended to read: "Whenever <br />feasible but to the final decision of the City Engineer <br />horizontal drainage ditches shall be constructed on graded <br />benches of sufficient width to allow a maintenance vehicle to <br />straddle the ditch". <br />Mr. Fairfield asked if that is still subject to the access <br />road- Mr. Elliott said it is. <br />Mr. Fairfield stated he understood that regarding Condition lVo. <br />'~ there would be no park fees as there is full dedication. <br />Mr_ 5wift agreed that is correct. <br />Page 6 <br />
