Chairman Lindsey discussed notification with Mr. Beratlis. Mr. <br />Beratlis responded that as a real estate broker, he sold 19 of <br />the lots in Foxbrough and bought two of the lots himself. When <br />he sold the lots he notified everyone concerned about the <br />proposed grading. He illustrated the effect of the grading to <br />his buyers by pointing to a distant telephone pole at the bottom <br />of the hill. Mr. Beratlis reported that he is not the only real <br />estate person selling lots in the area. Mr. Beratlis said he <br />has notified Allied Brokers and Vintage Realty of the grading <br />plan, but has no way to determine who they notify. Since Friday, <br />he has personally made contact with the owners of Lots 2, 4 and 5 <br />(the owner of Lot 1 was not available). The owners of the lots <br />most severely effected have acknowledged the fact, in writing, <br />that they have reviewed the grading plan. The first five lots <br />are all speculation homes builders. The people on Lot 4 have <br />sold the house and they have a written statement from their buyer <br />showing they are aware of the fill proposed. No attempt has been <br />made to cover up the proposed grading plan. It is unfortunate <br />Mr. King didn't get notice. The notice probably went to his <br />father whose name appears on the rolls. Mr. Beratlis reported <br />that Lot 1 will be 2 feet higher than grade (or the finish grade <br />of the Beratlis property). <br />Commissioner Michelotti was concerned that when fill is done and <br />the pads are located how the lots will be oriented and whether or <br />not they will have views. The property owners will not be <br />looking down onto swales when they look west. Mr. Beratlis said <br />the property owners are completely aware of this. <br />Commissioner Tarver asked if it was a normal practice to allow <br />grading of this type before a PUD or devleopment plan has gone <br />through the City's process. Mr. Quaglia stated that as part of <br />the preliminary map, a grading permit can be issued and dirt <br />stockpiled. Commissioner Tarver stated he appreciates that <br />affected people have been notified, but he would like to see the <br />matter go through the entire City process so that notice can be <br />made to all properties. <br />Mr. Beratlis reiterated that he has no intention of developing <br />his property for probably five years. He did state, however, <br />that he may submit a development plan prior to that time. <br />Commissioner Michelotti felt that for the protection of the <br />buyers there should be some written notification of some type so <br />that people know what is going on. Mr. Beratlis said there is no <br />way for him to notice buyers of speculation houses. Commissioner <br />Michelotti then asked if there is any type of homeowners <br />association in Foxbrough Estates. Mr. Beratlis said there is <br />none. She then asked Mr. Beratlis how close he is to coming in <br />with a plan for his property. Mr. Beratlis said he has no plans <br />at the present time and didn't know when he would have one to <br />present. <br />Mr. King spoke again in opposition to the proposed grading <br />reiterating that 30' of fill is excessive and impedes visual <br />views of the Foxbrough Estates and homes to the south of the <br />Minutes <br />Planning Commission <br />
