Gary King, Lot No. 1, Foxbrough Estates, who has a common <br />boundary to the subject site spoke against the proposed grading <br />plan and urged that the developer not be allowed to cut and fill <br />to the extent they desire to do so. The first he had knowledge <br />of the proposed grading plan was 48 hours prior to the Planning <br />Commission meeting when he was notified by Chris Beratlis by <br />telephone. Mr. King was adamantly opposed to having up to 30' <br />feet of fill along the common property line. People most <br />effected by the fill are not privy to the information concerning <br />the proposed grading permit. Mr. King stated that he feels the <br />property owners of the area are not having their rights <br />protected. Cut/Fill to the degree proposed will have an adverse <br />effect on Foxbrough Estates as a whole. Mr. King reported that <br />Mr. Beratlis said that he has made his buyers aware of the plan <br />for the future, but others who purchase lots from other <br />individuals are not being made aware of the plans. Mr. King <br />doubted that the owners of Lot 3 were notified of the proposed <br />grading plan. Mr. King reported that he had discussed the matter <br />with a new homeowner directly across the street from him and he <br />indicated that he was aware of the grading plan proposed. When <br />asked how he (the neighbor) felt about 30' of fill and the fact <br />that it would impair his view, he responded to Mr. King that he <br />was not aware of the extent of the fill. <br />Commissioner Hoyt commented that there is no map nor report <br />explaining what is to take place. <br />Commissioner Michelotti discussed the view from Mr. King's house <br />with him. Mr. King indicated that at the present time he has a <br />good view which will be impaired with approval of this grading <br />permit as proposed. Other properties won't be as affected by the <br />proposed grading because of their particular pad elevation. <br />The public hearing notice process was then discussed. Chairman <br />Lindsey asked Mr. Quaglia to review the usual procedure. Mr. <br />Quaglia explained that at the time of notice of the tentative map <br />the owner of the property was either Ralph Martin or HSC <br />Development and not the existing single-lot owners. <br />Commissioner Tarver then asked the status of Tract 5835 and the <br />subject Beratlis property and whether or not there is a proposal <br />for the subject site. Mr. Quaglia said no proposal has yet been <br />received for the Beratlis site. <br />Chairman Lindsey asked that if a plan came before the Planning <br />Commission for this property would the Planning Commission have <br />the authority to move the proposed fill. Mr. Quaglia said they <br />could require this or other changes. <br />Commissioner Tarver felt if 30' fill is allowed it might set out <br />the land for a specific type of development. <br />Chris Beratlis, 425 Main Street, represented Amador Valley <br />Savings and Loan as well as his personal interest.
