Commissioner Tarver asked Mr. Swift if this property was not <br />previously{ ~vned agricultural and then LAFCO said to gone it <br />something else. Mr. Swift responded that he was correct; the <br />rationale for that was that the initial study and Negative <br />Declaration that was adopted in conjunction with the <br />agricultural Zoning LAFCD felt did not address the future <br />development of the site. They wanted the Negative Declaration <br />to address all issues so they could use the initial study and <br />Negative Declaration for their environmental document and <br />processing of the application. They were concerned about a <br />lawsuit if they used the Plegative Declaration that was <br />previousl•{ done for the agricultural ~vning for their LAFCO <br />action. This is why it comes back before the Commission. <br />The public hearing was opened. <br />Brad Hirst, bi@~7 W. Las Fositas, represented the application. <br />He commented that Commissioner Tarver`s question and Mr. Swift`s <br />response was his presentation. In response to a question by <br />Commissioner Mahern, he stated that the Williamson Act contract <br />has been non-renewed so it will a>:pire in eight years. <br />A motion was made by Commissioner Hoyt, seconded by Commissioner <br />Berger that the !Negative Declaration prepared for Case RZ-B7-1:~ <br />be recommended for adoption inasmuch as project approvals would <br />have an insignificant adverse effect on the environment. <br />ROLL_CALL_VOTE <br />AYES: Commissioners Berger, Hoyt, Mahern, and Wise <br />Chairman Michelotti <br />!'NOES: Commissioner Tarver <br />ABSENT: Commissioner Lindsey <br />ABSTAIN: None <br />Resolution No. PC-88-t77 was entered and adopted recommending <br />approval of the Negative Declaration prepared far Case RZ-87-13 <br />as motioned. <br />A motion was made by Commissioner Hoyt, seconded by Commissioner <br />Berger recommending approval of Case RZ-87-13 as presented in <br />the staff report. <br />ROLL_CALL_VOTE <br />AYES: Commissioners Berger, Hoyt, Mahern, and Vice <br />Chairman Michelotti <br />NOES Commissioner Tarver <br />ABSENT: Commissioner Lindsey <br />ABSTAIN: None <br />Resolution No. FC-SS-C3S was entered and adapted recommending <br />approval of Case RZ-87-1~ as motioned. <br />F'age 7 <br />
