Existing Trees <br />27. The applicant shall comply with the tree preservation recommendations of <br />the tree report prepared by HortScience dated "Received May 18, 2006". <br />No tree trimming or pruning other than that specified in the tree report shall <br />occur. The applicant shall arrange for the horticultural consultant to <br />conduct a field inspection prior to issuance of demolition and grading <br />permits to ensure that all recommendations have been properly <br />implemented, including and measures needed to ensure the preservation <br />of the trees required to be preserved by this case. The consultant shall <br />certify in writing that such recommendations and any other applicable tree <br />preservation measures of this case have been followed. <br />28. On Lot 1, the two heritage size Monterey pine trees as shown on the tree <br />report prepared by HortScience dated "Received May 18, 2006", all trees <br />shown between the rear deck and the southern property line, and all trees <br />between the other areas of the house and the southern property line shall <br />be preserved, unless the trees are required to be removed per condition of <br />approval #14. Prior to commencement of any site work, the project <br />developer shall install tree protection fence, at the dripline of the existing <br />trees on the subject site to be preserved. <br />29. Prior to any site work, the project developer shall post cash, letter of credit, <br />or other security satisfactory to the Planning Director in the amount of <br />$5,000.00 for each tree to be preserved should any work, utilities or <br />otherwise, be conducted within an area in which potential impacts may be <br />anticipated. This cash bond or security shall be retained for one year <br />following acceptance of public improvements or completion of construction, <br />whichever is later, and shall be forfeited if the trees are destroyed or <br />substantially damaged. In the event any trees are destroyed or <br />substantially damaged, an arborists' assessment, at the developer's <br />expense, shall be required to determine the damage or loss, then for each <br />damaged or destroyed tree the applicant shall plant at least two native 24" <br />box non-deciduous trees in approximately the same location, and pay the <br />resultant value of the damaged or destroyed trees, as stated in the <br />Hortscience Report, Exhibit A, minus the cost of the replacement trees, to <br />the City's Urban Forestry Fund. <br />30. If the City Engineer determines additional grading must occur where a tree <br />required to be preserved is located, the applicant shall replace the tree <br />with at least two native 24" box non-deciduous trees in approximately the <br />same location. An arborists' assessment, at the developer's expense, shall <br />be required to determine the value of the tree to be removed and the <br />9 <br />
