resultant sum, minus the cost of the replacement trees, shall be paid to the <br />City's Urban Forestry Fund. The location and species of the replacement <br />tree shall be subject to the review and approval of the Planning Director. <br />Open Space Area <br />31. The open space area required by the Vineyard Avenue Corridor Specific <br />Plan shall be entirely located on Lot 3, shall be a minimum of 1,575 square <br />feet in size, and shall generally be located by the western property line. <br />The final location shall be subject to the review and approval of the <br />Planning Director. <br />32. The ownership, maintenance, and use of the open space area shall adhere <br />to the requirements of the Open Space Ownership and Maintenance Plan <br />approved as part of this PUD development plan. <br />33. With the recording of the parcel map, the applicant shall record a <br />conservation open space easement over the required open space area on <br />Lot 3. The wording of the easement shall be subject to the review and <br />approval of the City Attorney. <br />34. All future landscaping in the open space area shall be native species. <br />Maintenance Association/Agreement and CC&Rs <br />35. A maintenance association or agreement shall be created for the project, <br />as determined by the City Attorney. The CC&Rs or maintenance <br />agreement for the project shall clearly state: <br />a. At a minimum, the maintenance association or lot owners shall be <br />responsible for the maintenance of the following: <br />i. The maintenance of the open space area on Lot 3. <br />ii. All street landscaping and irrigation on Lot 3 within 10 feet of the <br />back of curb of Clara Lane. <br />iii. The driveway leading to Lot 1, including the two foot wide grass <br />strips adjacent to the driveway, and the "y" hammerhead on Lot 1. <br />iv. The bioswales including the bioswale landscaping and irrigation <br />system. <br />v. Any bioretention system and related landscaping and irrigation <br />systems. <br />
